Nissan A federal class action lawsuit claims Nissan knowingly sold certain Maxima, Altima and Quest vehicles equipped with defective automatic transmissions that can suddenly and unexpectedly fail while being driven.

According to the Nissan transmission defect class action lawsuit, the allegedly defective transmissions are present in 2004-2006 Nissan Maximas, 2005-2006 Nissan Altimas, and 2004-2007 Nissan Quests. The class action lawsuit claims Nissan knew, or should have known, since at least 2004 that the automatic transmissions in these vehicles are defective, which can cause them to break down prematurely; experience transmission slips, delayed shifts, and acceleration surging; and suffer mechanical failure.

Rather than alerting consumers about this safety hazard and offering to repair the vehicles, “Nissan has concealed this problem from its customers at the time of purchase or lease and thereafter,” the class action lawsuit states. Not only has this put consumers in danger, but it has also allowed Nissan to profit from the defect by selling replacement parts to Class Members.

The Nissan transmission defect class action lawsuit is brought on behalf of all U.S. consumers who purchased or leased any 2004 through 2006 Maxima, 2005 through 2006 Altima, or 2004 through 2007 Quest vehicle equipped with an automatic transmission. It is seeking class certification, damages, disgorgement of profits, and injunctive relief.

The case is Howard Teba v. Nissan North America, Inc. and Nissan Motor Company, Ltd., Case No. 12-cv-00332, U.S. District Court, Central District of California, Western Division.

UPDATE: This case was voluntarily dismissed by the plaintiff on June 29, 2012. Details behind the dismissal were not indicated in court documents.

    I have a 2006 Nissan Maxima with the exact same transmission problems. Started at 60,000 miles. Performed proper maintenance on the vehicle. There are hundreds of owners in blogs complaining about the exact same issue

    I have a 2005 Nissan Maxima and I’m having the same problems, I recently had a near death experience because my transmission slipped and violently jerked back into gear causing my steering wheel to pull hard left into oncoming traffic. I had my 2 small children in the car and this could’ve ended very badly. luckily the on coming driver managed to swerve out of the way. I’ve contacted the Nissan dealership near my home and they recommended I bring it in and have them look at it. They also stated that since I am no longer under warranty that I would have to pay for any service down on my vehicle. This is Bulls#!t. How do I add my name to this lawsuit. They quoted me roughly $4500 for repair. I looked into converting my auto to manual as to avoid all this but thats not cheap either. SOMEONE please Help!!!!

    i want in! i have a 2004 maxima with 95k miles on it and the transmission had to be replaced THREE times!! the first 2 were under warranty, now they want me to pay 3800 for this third transmission.

    I have a 2009 Altima. Transmission had to be replaced right over 60,000, after the warranty had expired. Dealership said that they had to extend the warranty because they were having trouble with them. Guess they were just gonna wait and not tell anybody till they had trouble. They replaced it free of charge. Now just wondering how long the new one will make it.

    Same issue….just bought a used 2005 Maxima 3.5 SL 60 days ago. Transmission already gone and they want 3600 to fix it. Would like to get in on this lawsuit. If anyone knows how, please let me know. Thanks!

    I have a 2005 maxima with 60,600 miles on it. Tranmision diagnosis from a nissan dealer revealed that it was “junk.” $3700 to fix. Consumer affairs at nissan said “we are not able to help you at this time.” Time to buy a hyuandai.

        I have a 2006 Maxima that I got new!!! It has 91,000 miles on it. I just started have problems with the transmission this winter. The same problems as the other comments. It has been at the dealership for two weeks with no response on the repairs!! I would like to be added to the lawsuit, please contact me!!

          My 2006 Maxima has only 83k miles on it and it has the same problem. I stopped driving it since January of this year because I was afraid that I would cause a bad accident because of the terrible jerking. It’s a shame that Nissan hasn’t do anything for their customers. I been a loyal customer, previously owned an Altima and a Versa but I will never buy any of their vehicle again!

        Make complaint to Nissans Consumer Affairs dept. Then file a complaint with the State’s Consumer Affairs . Your state may have a formal complaint process you can follow to make a statement about your rights as a consumer. I did. Tell everyone you know.

          We have a 2005 Nissan Quest with the same problem. Happened this past Easter Morning. Getting quoates for repair. I have read alot about this problem from others. This is extremely dangerous if failure happens at interstate speeds.

        I have a 2005 Nissan Maxima with only 43000 miles, I too believe that the transmission is blown. The car died o me in the middle of a highway, pulled over and now the service engine light is on. I will take it to a Nissan dealer and see what Nissan has to say about this

      I had the same problem with my Nissan Maxima a 2006. Which cost me 1500.00 to have it repaired I did not know there was a recall on this car. Repaired it in February 2013 aftter the problem made me afraid to drive the vehicle. I also had to pay 600.00 to rent a car to drive until the car was repaired. How do I join the class action lawsuit.

      I have 2000 maxima… it would idle really high an jerk alot parked an when driven. I was advised to change the throttle body an sensors. Did that but now the jerking is worse an the tranny sticks in 2nd to 3rd. I mostly drive it in D2…!! Add me to this lawsuit… still working on some kind of solution. Great cars but it sucks the company won’t do a recall… guess they don’t care about us consumers getting hurt…!! Good thing we in America where we can take them to court for our safety…!! Judicial system don’t fail us now…!!

      I have had same.issues since bought the car which is 06,maxima. Was in Nissan for week and then transmission shop for three days with undetermined cause and was told.to.monitor. 5k later car slipping so bad unable.to drive

      I have a 2005 Nissan Maxima and mine did the same thing now it is setting in the drive , I can’t drive because my daughter was driving it and it made a noise then everything on the dash quit working then it quit pulling… so I guess the transmission is out…But can’t understand why everything on the dash stopped working … the only thing that stayed on was the radio!!! Imagine that.. I wish we could get something for the problems this has caused ….I now have nothing to drive!!! Wish I was on this Class Action Law Suit to!!

      I have a 2006 Maxima & have the same exact problems with my transmission I had to get mine rebuild for 2400$ the transmission went completely out on me without any warning signs in the middle of a big intersection if it wasn’t for the traffic light being on red for the other cars I don’t know if I would be dead or alive today…something needs to be done about these transmissions asap
