Nissan A federal class action lawsuit claims Nissan knowingly sold certain Maxima, Altima and Quest vehicles equipped with defective automatic transmissions that can suddenly and unexpectedly fail while being driven.

According to the Nissan transmission defect class action lawsuit, the allegedly defective transmissions are present in 2004-2006 Nissan Maximas, 2005-2006 Nissan Altimas, and 2004-2007 Nissan Quests. The class action lawsuit claims Nissan knew, or should have known, since at least 2004 that the automatic transmissions in these vehicles are defective, which can cause them to break down prematurely; experience transmission slips, delayed shifts, and acceleration surging; and suffer mechanical failure.

Rather than alerting consumers about this safety hazard and offering to repair the vehicles, “Nissan has concealed this problem from its customers at the time of purchase or lease and thereafter,” the class action lawsuit states. Not only has this put consumers in danger, but it has also allowed Nissan to profit from the defect by selling replacement parts to Class Members.

The Nissan transmission defect class action lawsuit is brought on behalf of all U.S. consumers who purchased or leased any 2004 through 2006 Maxima, 2005 through 2006 Altima, or 2004 through 2007 Quest vehicle equipped with an automatic transmission. It is seeking class certification, damages, disgorgement of profits, and injunctive relief.

The case is Howard Teba v. Nissan North America, Inc. and Nissan Motor Company, Ltd., Case No. 12-cv-00332, U.S. District Court, Central District of California, Western Division.

UPDATE: This case was voluntarily dismissed by the plaintiff on June 29, 2012. Details behind the dismissal were not indicated in court documents.

    I leased my 2007 new back in 2007 and bought at 3 year lease finish. Back in 2016 I noticed I wasn’t feeling the cvt changing while driving. This past year during this Pandemic and while out of a job I had to put out around $400 for the mechanic we took to just to make drivable until we are able to afford something better. He said the transmission was SHOT and my Murano has 120k miles on it. A bit disappointed as interior is still I’m good shape and I made sure I put under 10k miles a year. Guy said we could change transmission but it would cost us around $5k and that is higher than current value of the car! Will not buy Nissan again! Wish I would have researched back when I first began to notice changes. Now I am looking to purchase a new reliable and safe vehicle to drive my 5yo around in and struggling to make it financially.

    I own a 2005 nissan maxima i always liked the cool look they have and always wanted to own one…but since the moment i got one i have only been putting money and time and car keeps coming up with new problems every day..if dont shut off on me while diving on with my family..its heating problem even aftrr replacing mostly all cooling related parts paying more for oem parts don’t make a difference n jus waste off money…poor poor design ..and big dissapointment !!!!!!

    I’ve had 2 Nissan Maxima SE 1 was a 2005 and the other is a 2006, the first one transmission failed and on the 2nd one had one replaced. When will Nissan Do something about it?!!!

    I have a 2006 nissan altima se-r 3.5 with 85,000 miles on it the transmission acting put it in reverse and drive It takes a while for start moving Need somebody to help me out on this this is my 1st issue

    I have a 05 maxima my problem start 4 years ago brought it out the show case jerking down shifting rpm going up and down Nissan no this have not gotten it fix yet

    I bought a 2015 Nissan Altima in 2015. I only had that car for a year and a half before the transmission started messing up. There is no way a 2 year old car should be stalling and jerking. Nissan had to have know about these issues with their vehicles. I really wish this lawsuit was not dropped. Nissan is definitely liable. I was out of a lot of money trading that car in. They intentionally make these cars to not last.

    I brought my Nissan Maxima 2004 brand New. I would notice some slight jerks and ,during my service visit I mentioned it to the Svc people at Nissan, I was told that they couldn’t find anything wrong with the car, I trusted them. Some years Later I noticed the car would prolong in changing gears, and it got to the point where when I started to take off , at a light it would procrastinate in picking up speed, the car was very unsafe, and scary. I missed having many accidents due to the poor performance of this car. I had to transport my grands back and forth to school etc. and the car was not safe. I called Nissian and complained over and over,they had no complaints nor compensation for this 04 Nissan Maxima . I couldn’t afford to come out of pocket all at once to replace the transmission, so I had to go in debt to by a car that work . This was the 3rd maxima that I had owned the 2 cars prior to the 04were excellent. That’s why I trust the car, and brought another but the 04 was a lemon.

    My car just turned 65000 miles when transmission started acting up. Their transmissions are just as bad as the paint they use cheap worthless crappie. I paid to have it reclear coated and the clear wouldn’t stick to the factory base coat . I contacted the corporate office and the told men I was stuck with the crappy workmanship. In closing Nissan makes cheap cars and has horrible customer service all the way to mangers and CEOs
