New York State Attorney General Letitia James announced more than $1.9 million in Nissan settlements to resolve allegations the dealerships overcharged New Yorkers who wanted to purchase the vehicle at the end of their lease term.

An investigation through James’ office reportedly found five Nissan car dealerships in New York City and on Long Island inflated the vehicles’ prices or added bogus fees from 2020 to 2023.

The Nissan settlements require the dealerships to pay $1.6 million in restitution to more than 1,100 New Yorkers plus a $340,000 civil penalty.

“Ignoring agreements and adding bogus fees harms New York consumers, and that is something my office won’t allow to go unchallenged,” James says in a press release about the settlements over the alleged Nissan overcharging.

“These car dealerships lined their pockets at the expense of hardworking New Yorkers who were trying to have a reliable car to get to work, take their children to school, run errands and live their daily lives.

“Our investigation and settlement put money back into New Yorkers’ pockets and sends a clear message that lying to New Yorkers and manipulating costs with shady tactics will not be tolerated.”

Investigation into overcharging results in Nissan settlements, consumer refunds

After consumers complained to the New York attorney general’s office, James launched an investigation into Baron Nissan on Long Island, Nissan of Westbury on Long Island, Nissan of Kings in Brooklyn, Nissan of Queens and Nissan of Staten Island.

Each of the consumers leased their vehicles under an agreement that gave them an option to purchase the vehicle for a certain amount once the lease term ended, according to the press release. However, the consumers complained the dealerships overcharged them when they tried to execute that option. 

The overcharging allegedly included adding dealership or administrative fees, the press release states. In some cases, the Nissan dealerships allegedly hiked the price of the vehicle and fees on the invoices provided to consumers. Some consumers were allegedly charged as much as $7,000 on a vehicle that was worth $18,000.

The Nissan settlements impose penalties based on the number of consumers the dealerships overcharged and the severity of the overcharging, according to the press release. Additionally, the dealerships agreed to audit all lease-to-own deals made since the start of the attorney general’s office investigation and issue refunds to overcharged consumers.

Consumers recently hit Nissan with a class action lawsuit alleging the automaker knowingly sold certain Nissan Pathfinder and Infiniti QX60 vehicles containing radiator cooling fan defects.

    I am problems with my 2015 Nissan Altima with 129,444 miles Transmission now. I took it to the dealership and they told me its close to $5500 to repair, but the car in their opinion isn’t worth it on top of the additional $4000 worth of other repairs they claim it needs. I just had routine maintenance done.
