Yaz lawsuitA New York woman has filed a Yaz lawsuit against Bayer Healthcare Pharmaceuticals, alleging that she suffered from a sinus injury with potentially dangerous consequences which she claims was caused by the birth control pill.

Plaintiff Cheryl Hornberger says that she began taking Yaz in September 2010 and was diagnosed with a sinus thrombosis, or clotting of the blood in the sinus cavity, roughly 18 months later. According to her Yaz lawsuit, if Bayer adequately warned patients of the risk, the injury could have been prevented because she would have opted for a different birth control pill.

The documentation and research cited in the Yaz lawsuit dates back to at least 2002, when a medical journal noted that Dutch doctors were telling women to use other oral contraceptive options due to the risks involved, including Yaz blood clot side effects that can occur in any region of the body. Other countries’ equivalents of the U.S. Food and Drug Administration have recommended the use of other birth control pills unless there is an otherwise compelling reason not to do so.

By 2011, the British Medical Journal noted that contraceptives in that family, which also includes Yasmin, Beyaz and Ocella, are “associated with a higher risk of venous thrombosis than” older options and that there is “no clear evidence” that the pills “confer benefits above those of other oral contraceptives[.]”

Hornberger’s Yaz lawsuit notes that Bayer had to issue corrective advertising regarding over-promotion of benefits and minimizing side effects.

A sinus thrombosis can be very problematic, as it can include stroke-like symptoms, abnormal vision and even seizures.

The Yaz lawsuit is Cheryl Hornberger v. Bayer Healthcare Pharmaceuticals Inc., et al., Case No. 14-cv-10200, in the U.S. District Court for the Southern District of Illinois.
