Walmart class action lawsuit overview:

  • Who: Plaintiff Lee Ann Winter filed a class action lawsuit against Walmart Inc.
  • Why: Winter claims Walmart falsely advertises its Great Value brand stevia sweeteners as being made with stevia extract when they actually contain erythritol.
  • Where: The Walmart class action lawsuit was filed in California federal court.

A new class action lawsuit claims Walmart falsely advertises its Great Value brand stevia sweeteners as being made with stevia extract when they actually contain mostly erythritol.

Plaintiff Lee Ann Winter claims Walmartโ€™s stevia sweeteners are primarily sweetened with erythritol, a chemically processed sugar alcohol with known health risks, including heart attack, stroke and digestive issues.

Winter claims Walmart prominently labels its stevia sweeteners as being made with stevia extract and that consumers โ€œare misled to believe that they are purchasing a sweetener whose sweetness is derived solely from stevia extract.โ€

The plaintiff wants to represent a California class of consumers who purchased Walmartโ€™s stevia sweeteners within the past four years. She claims Walmart is liable for breach of express warranty, quasi-contract and violations of Californiaโ€™s consumer protection laws.

Lab tests reveal minimum stevia in some sweeteners, lawsuit claims

Winter claims an independent laboratory testing of Walmartโ€™s stevia sweeteners found they contain significant amounts of erythritol.

Tests allegedly revealed the Great Value No Calorie Stevia Packets contained 94.44% erythritol and the Great Value No Calorie Stevia Sweetener Sugar Substitute 59.12% erythritol.

Winter argues that Walmartโ€™s labeling misleads consumers into believing that the productsโ€™ sweetness comes primarily from stevia extract when, in fact, they contain only trace amounts of the ingredient, or less than half of what consumers might expect.

The plaintiff claims she and other consumers have suffered economic injury by paying a premium for a product they believed was primarily sweetened with stevia extract.

Winter demands a jury trial and seeks declaratory and injunctive relief, compensatory and statutory damages, other monetary relief, attorneysโ€™ fees and costs.

Meanwhile, another class action lawsuit filed against Walmart claims independent testing revealed Great Value Organic Chia Seeds contained eight times the allowable level of mold.
