Volvo class action lawsuit overview:

  • Who: A group of consumers filed a class action lawsuit against Volvo Car USA LLC.
  • Why: The plaintiffs allege Volvo sold vehicles with defective infotainment systems that can cause the rearview camera and other safety features to malfunction.
  • Where: The Volvo class action lawsuit was filed in New Jersey federal court.

A new class action lawsuit alleges Volvo sold vehicles with defective infotainment systems that can cause the rearview camera and other safety features to malfunction.

Plaintiff John Alopogianis and three others filed the Volvo class action lawsuit on Oct. 26 in New Jersey federal court.

They claim the issue affects several models from 2021 to 2025, including the XC40, C40, XC60, XC90, S60, S90, V60, V90, EX30, EX40 and EX90.

According to the Volvo class action lawsuit, the vehiclesโ€™ Android Automotive Operating System (AAOS) is prone to freezing, crashing or becoming unresponsive, leading to the loss of critical functions like navigation, audio, climate controls and the rearview camera.

The plaintiffs allege Volvo has been aware of the defect since at least 2021 but has failed to provide an effective fix, leaving owners with vehicles that are unsafe to drive.

Lawsuit: Volvo infotainment defects compromise safety

The plaintiffs argue that the AAOS system is central to the operation of the vehicle, controlling everything from navigation to climate settings to the rearview camera. When the infotainment system malfunctions, drivers can lose access to these critical functions, the class action lawsuit claims.

The plaintiffs allege that Volvoโ€™s attempts to fix the issue through software updates have been ineffective, and that the automaker has not provided a permanent solution.

They claim they experienced problems with their vehiclesโ€™ infotainment systems shortly after purchase. In each case, Volvo dealerships attempted multiple repairs, including software updates and hardware replacements, but the issues allegedly persisted.

The class action lawsuit claims Volvo violated consumer protection laws by failing to disclose the defect to buyers and not providing an effective remedy.

The plaintiffs are suing on behalf of anyone who purchased or leased one of the affected Volvo models. They are seeking damages and restitution as well as an order requiring Volvo to notify owners about the defect and provide a permanent fix.

In an ongoing Volvo class action lawsuit filed earlier this year, a consumer is suing the automaker for failing to fix a similar Android infotainment system defect that affected more than 400,000 vehicles.
