The estate of a Georgia woman alleges that she died as a result of unnecessarily dangerous kidney dialysis chemicals manufactured by Fresenius Medical Care, according to a newly filed GranuFlo cardiac arrest lawsuit.
Essie Thompson was reportedly being treated for renal failure at an Emory University Hospital in Atlanta through the first half of 2011. However, she died as a result of kidney dialysis and the predicate GranuFlo or NaturaLyte heart failure side effects, according to her GranuFlo lawsuit. Since there are so many cases that have been consolidated into multidistrict litigation, plaintiffs have the ability to file a simplified complaint that only notes the injuries.
As a result, one has to look at the master complaint in the GranuFlo MDL to see the specific allegations. Similar to a class action lawsuit, NaturaLyte lawsuit attorneys have similar facts that they use on behalf of their clients, the only difference being that there are separate actions and trials that are possible. In general, though, the GranuFlo lawsuit alleges that Fresenius Medical Care concealed the possibility of alkalosis due to the use of sodium diacetate, which has twice the basic compounds of other kidney dialysis agents.
As far back as the early 2000s, internal memos suggest that company officials were aware of the fact that dosages would have to be decreased in order to reduce the possibility of NaturaLyte heart failure side effects. Continuing analysis by the medical staff showed that hundreds of people had died as a result of the alkalosis issue in one year alone. A memo reporting those results was distributed to centers operated by Fresenius on Nov. 4, 2011.
Other facilities, such as the one that Thompson used, allegedly would not have known of these issues until the memo was leaked in March 2012, roughly a decade after the initial reports and just under one year after the woman’s death. Had Fresenius Medical Care acted properly, according to her estate and other NaturaLyte lawsuit attorneys, that would not have happened.
The GranuFlo Cardiac Arrest Lawsuit is Bernice Gregory, et al. v. Fresenius Medical Care Holdings Inc., et al., Case No. 14-cv-12229, in the U.S. District Court for the District of Massachusetts.
