iStock-Kidney-Dialysis-GranuFloAn unknown party has filed a GranuFlo wrongful death lawsuit on behalf of a woman who died following kidney dialysis treatment at a Fresenius Medical Care facility in Mississippi.

According to the GranuFlo lawsuit, the woman was undergoing treatment in 2012 when she suffered from NaturaLyte cardiac arrest side effects. Since the wrongful death lawsuit was filed through an approved master complaint that covers the filing of GranuFlo and NaturaLyte (its sister drug) lawsuits, there are few other details, including who is taking action on behalf of Cathy Penisse McCoy.

Generally speaking, the allegations are that Fresenius Medical Care, which not only operates kidney dialysis centers but also sells and markets chemicals used in facilities it operates (and sells to competitors), knew, or should have known, the risks involved with using the chemical sodium acetate, which increases bicarbonate levels.

While the company alleges that the litigation started by GranuFlo class action lawsuit attorneys came after a 2012 recall following the release of a confidential memo regarding hundreds of deaths, the master complaint argues that the company had documentation of these risks much earlier. The company’s medical officer noted that there was an issue in 2001 when he told other officials about possibilities of problems that would later be described by plaintiffs as NaturaLyte cardiac arrest side effects.

The GranuFlo lawsuit also noted a 2004 study indicating that numerous patients were experiencing issues with increased bicarbonate levels and “an increase in cases of metabolic alkalosis as a result of the administration of [the chemicals] containing diacetate.” The GranuFlo class action lawsuit attorneys who helped in drafting the master complaint note that hundreds of thousands of patients were allegedly exposed to these risks whether they were patients at a center run by Fresenius Medical Care or of its competitors that used the chemicals in question.

The GranuFlo wrongful death lawsuit is Cathy Penisse McCoy v. Fresenius USA Inc., et al., Case No. 14-cv-10696, in the U.S. District Court for the District of Massachusetts. It was filed directly into In re: Fresenius GranuFlo/NaturaLyte Dialysate Products Liability Litigation, MDL No. 2428, in the U.S. District Court for the District of Massachusetts.
