A Mirena IUD user named Diana Barron has filed a product liability lawsuit against Bayer Pharmaceuticals Inc., alleging that the Mirena IUD malfunctioned and caused her to suffer serious complications.
The Mirena IUD is a form of birth control. It is a small, T-shaped piece of plastic designed to be inserted into the uterus by a physician, where it can remain in place for up to five years. It prevents pregnancy by releasing hormones that block ovulation and thicken the cervical mucus.
Per Barron’s Mirena lawsuit, she had the Mirena IUD implanted in September of 2009. The insertion was without incident. In June 2010, she says she began to suffer from vomiting and pain. Her physicians allegedly discovered that the Mirena IUD perforated her uterus and was moving around in her abdominal cavity. According to the Mirena IUD lawsuit, Barron required laparoscopic surgery to remove the device.
Barron’s Mirena IUD lawsuit joins others that allege that Bayer was aware of these risks associated with the intrauterine device. The lawsuit further asserts that not only was Bayer aware of the risks, but that they actively promoted the drug in spite of this knowledge. To support this allegation, the lawsuit mentions a warning letter Bayer received from the Department of Health and Human Services Division of Drug Marketing, Advertising, and Communications (DDMAC), which stated that Bayer’s marketing program for the Mirena IUD was exaggerating the device’s benefits, while downplaying the risks. The lawsuit seeks medical costs, punitive damages, legal costs, and other damages.
The Mirena IUD lawsuit is just one of many that are currently pending against Bayer. Many of the cases have been joined together in multidistrict litigation (MDL) against Bayer. MDL is a type of group lawsuit, similar to a class action lawsuit, in which a group of people allege similar damage at the hands of the same defendant. MDL and class action lawsuits are designed to save both the parties involved and the legal system time, money, and other resources.
The Mirena IUD lawsuit is formally titled Diana Barron v. Bayer Healthcare Pharmaceuticals Inc., Case No. 7:13-cv-08328-CS, in the U.S. District Court for the Northern District of Texas, Dallas Division.
