A group of Acura drivers has asked a California judge to approve a $4 million settlement in a class action lawsuit alleging that the “infotainment systems” malfunction in the 2019 and 2020 Acura RDX vehicles.
The $4 million class action settlement includes attorneys’ fees, litigation expenses, and service awards to the 18 lead plaintiffs.
Defendant, American Honda Motor Company, Inc, has issued three recalls, dozens of dealer communications, and numerous software updates to address the alleged Acura Infotainment defects, the motion notes.
The multimillion-dollar settlement comes after a Class of Acura drivers was certified by a federal judge last year.
The proposed class action settlement also requires an independent engineering expert to confirm the efficacy of Honda’s countermeasures, extending the vehicles’ warranties to ensure the countermeasures are effective in the field, compensating qualifying vehicle owners for the inconvenience and hassle they have experienced and providing a mechanism for qualifying vehicle owners to receive reimbursement for eligible out-of-pocket expenses.
“The plaintiffs include a doctor who was fighting COVID-19 on the front lines at the onset of the pandemic, high-risk individuals who were isolated in their homes, a spouse to a patient in intensive care and a traveler stranded in India by COVID-19 travel bans,” the motion states. “Yet despite these hardships, plaintiffs worked through extraordinary challenges to prosecute this action for the benefit of the class.”
Given the resources devoted to the Acura class action amid the COVID-19 pandemic and the results achieved on behalf of the Class, the requested awards are reasonable and should be approved, argues the motion.
Acura Driver Suffered ‘Overpayment and Diminished Value of the Vehicle,’ Alleged Class Action
Plaintiff Jimmy Banh, an Android user, purchased an Acura after a salesperson at the dealership reportedly told him that Android Auto would be coming to the vehicle within “a few weeks or months.”
However, 10 months after his purchase, there was still no software update containing Android Auto. Banh has been forced to use an adaptor, USB stick, and MP3 player to listen to music, the lawsuit claims.
Additionally, Banh says he “has suffered an ascertainable loss as a result of defendant’s wrongful conduct associated with the infotainment system including, but not limited to, overpayment and diminished value of the vehicle.“
