Humana’s Medtronic bone graft lawsuit alleging that a medical device maker violated the Racketeer-Influenced Corruption Act actually will play a huge role in helping patients who suffered Infuse bone graft complications.
Usually, federal judges on the U.S. Judicial Panel on Multidistrict Litigation will consolidate cases in place of a jurist certifying a Medtronic class action lawsuit. Right now, there is no Infuse bone graft lawsuit multidistrict litigation (MDL) or mass tort, so they are all individual Infuse lawsuits. Any efforts by Humana will act as a force multiplier in that regard.
The Medtronic Infuse bone graft lawsuit filed by Humana makes similar claims to those that Infuse patients who suffered from bone graft complications are making, including allegations that the company paid hundreds of millions of dollars for questionable medical journal reports and advertising for off-label surgical uses. The Medtronic product is only approved for lumbar spinal repairs but the company reportedly pushed for unapproved uses.
With a major insurer pushing back, anyone who has filed a Infuse bone graft lawsuit will benefit from Humana’s legal team as they work on depositions and the discovery process. It will speed up the process and put documents into the public record that could be of major use even if multidistrict litigation is the eventual format rather than a Medtronic class action lawsuit.
Keep in mind that it will also allow plaintiffs and their counsel to see what strategies and legal arguments will hold weight with federal judges. Basically, Humana is helping to do a lot of the leg work and delving more deeply into the actions of Medtronic and its product as well as any marketing techniques to patients and doctors the bone graft maker used.
