A new class action lawsuit accuses Home Depot of selling consumers’ personally identifiable information (PII) to third parties without providing them with notice.
Plaintiff William E. Wright claims Home Depot sells the PII it collects from its customers at retail stores to third parties without providing notice to them, in violation of Virginia’s Personal Information Privacy Act.
Wright argues Home Depot operates a retail media network called Orange Apron Media that allows brands to advertise directly to its customers through the Home Depot website, social media channels and in stores.
“Home Depot collects and sells PII with the LiveRamp clean room to create enhanced profiles for its retail-media-network customers,” the data privacy class action lawsuit says.
Wright seeks to represent a nationwide class and a Virginia subclass of consumers whose PII was allegedly sold or disclosed by Home Depot without notice during the applicable class periods.
Class action: Home Depot earns more revenue by selling PII
Wright claims Home Depot is able to earn more revenue by offering enhanced consumer profiles that allow Orange Apron Media to better target advertisements to its customers.
“Home Depot profits handsomely from the unauthorized sale and disclosure of consumers’ purchasing patterns and other personal information and does so at the expense of its consumers’ statutory privacy rights,” the Home Depot class action lawsuit says.
Wright claims Home Depot is guilty of unjust enrichment and violating Virginia’s Personal Information Privacy Act. He demands a jury trial and requests declaratory and injunctive relief and an award of statutory damages for himself and all class members.
In other data privacy violations, Home Depot is accused of using automatic license plate recognition technology to track the movements of customers’ vehicles without their knowledge or consent.
