Macy’s class action lawsuit overview:

  • Who: Plaintiff Iman Shaw filed a class action lawsuit against Macy’s Inc. and Tarmo LLC.
  • Why: Shaw claims the companies deceptively market a furniture protection plan called WorryNoMore Warranty.

A new class action lawsuit alleges Macy’s and Tarmo worked together to deceptively market a furniture protection plan called WorryNoMore Warranty.

Plaintiff Iman Shaw claims Macy’s deceptively markets the WorryNoMore Warranty and that Tarmo, which administers the plan, unfairly denies valid claims.

Shaw argues Macy’s and Tarmo’s actions violate California’s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act. The Macy’s class action lawsuit also brings claims for unjust enrichment, breach of contract, breach of express warranty, and breach of the implied covenant of good faith and fair dealing.

Shaw wants to represent a class of consumers who filed a claim pursuant to the WorryNoMore Warranty within the applicable statute of limitations and were denied.

The plaintiff demands a jury trial and requests compensatory damages, restitution, attorneys’ fees and costs, and injunctive and declaratory relief.

Lawsuit: Macy’s wrongfully denied thousands of warranty claims

Shaw claims the proposed class contains thousands of members or more. He argues Macy’s and Tarmo’s actions place at least $5 million in controversy, which is the threshold for removal under the Class Action Fairness Act (CAFA).

According to the Macy’s class action lawsuit, Tarmo’s records show that about 34,000 individuals had claims deemed not covered by the WorryNoMore Warranty between April 2022 and the present.

The average cost of a repair service covered by the WorryNoMore Warranty plan exceeds $250, Shaw claims. Therefore, the plaintiff argues, even using a conservative estimate of $200 per repair, the amount at stake exceeds $5 million.

Macy’s and Tarmo filed a notice of removal on July 2, 2026, arguing that the case belongs in federal court because it meets the CAFA requirements for removal.

In another legal action against Macy’s, two class action lawsuits accuse Macy’s and Discount Tire of sending deceptive promotional emails to Washington residents.
