home-depot-logoTop Class Actions viewers say they are receiving checks, some of which exceed $8,000, in a second distribution of payments from a Home Depot data breach class action settlement.

The first batch of payments, sent out around April of this year, went out to qualifying Class Members who filed valid claims for actual losses related to the data breach.

According to comments and posts on the Top Class Actions Facebook page, viewers are now receiving a second check for hundreds and sometimes thousands of dollars.

After the first distribution, some of the remaining funds were used to reimburse Home Depot for the costs of settlement administration and of the Identity Guard Monitoring Services provided to qualifying Class Members.

The current and second round of payments distributes the last of the settlement fund.

This Home Depot class action settlement resolves claims over a data breach that affected the self-checkout counters at Home Depot stores across the U.S.

According to the company’s announcement, the breach exposed the credit card information of customers who used self-checkout counters between April 10 and Sept. 13, 2014. A separate file containing customers’ email addresses was also exposed. Around 40 million Home Depot customers were believed to be affected by this breach.

Several Home Depot class actions that followed the company’s announcement were consolidated into a single action, which ultimately led to the current settlement.

Home Depot established a $13 million settlement fund to compensate customers affected by the data breach. Qualifying Class Members could be entitled to up to $10,000 each for documented losses related to the breach.

The settlement also required Home Depot to provide up to 18 months’ worth of Identity Guard Monitoring Services to help protect affected customers against identity theft and credit fraud.

Class Members eligible to claim benefits included persons who used a credit or debit card at a self-checkout stand at a U.S. Home Depot store between April 10 and Sept. 13, 2014 and whose payment card information was compromised, as well as all persons who received notification that their email address was compromised and those who received a settlement notice notifying them that they were a Class Member.

The deadline to submit a claim for the Home Depot data breach settlement passed on Oct. 29, 2016.

  1. James Va says:

Anyone still waiting for there second check?

    1. Peg says:

      Still waiting for mine.

  2. Larry says:

KCC sends out checks once a month.

The first set of supplemental checks were mailed on October 27th, and sent to those who had submitted a W-9 early enough to meet the cutoff for that month.

If you submitted a W-9 that wasn’t processed in time for the October 27th mailing, you should receive your supplemental check sometime shortly after they mail the next checks on November 28th.

  3. Blue says:

The administrator is giving me the run-around about my claim.
I called them up today. They told me none of the checks have been mailed. I asked them to double check, but they confirmed no checks have been mailed.
    They do have my w-9.
    Weird.

  5. hannah says:

called and was told all checks were mailed out..

    1. aaron says:

The court filing says all checks were mailed to those who submitted a W9.

Some W9 forms haven’t been returned to KCC, so some checks have not been mailed.

If you received a W9 but didn’t receive a check, I would contact KCC and ask if your W9 was received.

Here is what the court filing says:

“On October 27, 2017, KCC issued supplemental claimant payments
by check to all Class Members who thus far have submitted valid taxpayer
identification numbers or did not need to provide one. As KCC receives additional
valid tax forms, KCC will issue supplemental payments to those Class Members.”
