Ford Mustang, Expedition, Explorer Corrosion Peeling Paint Class Action Lawsuit Overview:

  • Who: Drivers of Ford Mustangs, Expeditions and Explorers have been denied class action certification in their lawsuit against Ford.
  • Why: A judge ruled that the plaintiffs do not have standing to represent all the drivers they sought to represent.
  • Where: The decision was made in a Florida federal court.

A lawsuit claiming that drivers’ Ford Mustang, Ford Expedition and Ford Explorer vehicles have aluminum panels that corrode and rust has been denied class action certification. 

Florida federal Judge Rodolfo A. Ruiz II recently denied the plaintiffs’ request for class action certification for four different Classes of consumers, Car Complaints reports

This is just one of a number of Ford corrosion and peeling paint class action lawsuits going through the courts right now.

The plaintiffs in this case had alleged that all 2013-2018 Ford Mustang, Ford Expedition and Ford Explorer vehicles are made with hoods and other panels that corrode.

This causes the paint on the hoods to bubble, flake, peel and blister, and the lawsuit states that the paint warranty is a “sham” because rust and corrosion aren’t covered.

Plaintiffs Don’t Have Standing, Judge Rules

However, Judge Ruiz II reportedly ruled that the plaintiffs could only assert claims under the state law that their own, personal, claim arose from.

He said the plaintiffs looking to represent a nationwide Class of Ford drivers did not have standing to bring claims on behalf of others who owned makes and models of cars that none of the plaintiffs themselves had owned or leased. 

Ruiz II ruled that the seven named plaintiffs cannot, therefore, represent Expedition owners, purchasers of Ford vehicles later than model year 2016, or plaintiffs outside the states of California, Florida, New York, Indiana and Illinois.

Ruiz II also took issue with the Class definitions, saying, if certified, the Ford paint peeling class action lawsuit would include about 800,000 owners, but the vast majority never had any corrosion or paint problems with their Ford vehicles.

He added that while the plaintiffs tried to prove all the vehicles share a common design defect, there are huge differences not only in models and model years, but also in manufacturing techniques within various production runs of the same model and model years.

He reportedly said it is “nonsensical” for the plaintiffs to ask the court to ignore these differences.

Ford Faces Multiple Peeling Paint Lawsuits

Meanwhile, in 2019, Ford was hit with a class action lawsuit alleging Ford F-150 vehicles possess defects in their paint and/or paint primer and in the aluminum body panels that can cause the vehicles to corrode prematurely.

In that case, the plaintiff alleged that Ford knew or should have known about the defect but did not try to provide a remedy, citing numerous consumer complaints about the issue.

Also in 2019, another Ford Explorer owner filed a class action lawsuit against the vehicle maker over claims that its hoods are defective in a way that causes them to corrode prematurely.

The lawsuit says that Ford has made Explorers since 1991, and in 2000, began making the hoods with aluminum as opposed to steel.

Allegedly, by 2011, Ford advertised that the vehicles were sturdy but lighter than before, because of these frames. However, this material switch allegedly resulted in the vehicles being much less durable, because the aluminum hoods quickly corrode.

    My 07 Ford Expedition starting peeling on the rear hatch 14 years ago. Ford said they would do nothing.

    I have a Ford Explorer, and my paint on my hood is bubbling. Ford will not take care of it.

    My 2017 Mustang with 40k miles is bubbling in 2 corners of the hood hear the driver headlight. Looks unsightly, but haven’t gotten a quote yet. Very disappointed in Ford not owning up to their product, and a corrupt federal judge putting corporations ahead of people.

    My 2017 F-150 paint started peeling along the roof cap edge above the doors. The repair is estimated at approximately $2500 CAD. I think that FORD Canada should split the bill with me.

    2017 gt350/lighting blue. I have 4 spots on my hood that’s starting to bubble. 2 of the 4 are under the Shelby stripes, in which you can tell very well.

    My 2015 Ford Explorer and my son’s 2015 Ford Mustang have bad paint blistering and peeling in and inside the hood! Very upset that Ford is so irresponsible and negligent!

    My 2017 Ford Escape Titanium has the White Platinum Met Tri Coat paint. has 52,246 miles on it. Paint peeling and chipping on the pillars around the windshield.

    My 2016 mustang has blistering and corrosion on the hood. I’ve have been to local repaint shops who said they wouldn’t touch it because it’s a ford problem. So I’m basically stuck with this $50,000 mustang convertible that has bubbling blisters with corrosion on all four corners of the hood that are only getting bigger and bigger and no way to get it fixed. It’s truly embarrassing.
