A proposed class action lawsuit settlement has been reached over allegations eMachines sold defective computers. If you purchased an eMachines computer, you may be entitled to a replacement computer, accessories or $62.50 in cash if the class action settlement is approved.
The eMachines settlement will resolve a class action lawsuit, titled Stroud v. eMachines Inc., that alleges the defendants sold computers with a defective part that could cause the loss or corruption of data written to, or read from, a floppy disk. eMachines denies any wrongdoing but has agreed to a class action lawsuit settlement to resolve the litigation.
Class Members of the eMachines computer class action settlement include anyone who purchased the following computers from eMachines or an eMachines authorized reseller (a retail store) in the United States on or after December 31, 1997:
Class Members have the option to receive a replacement computer and/or accessories or a cash payment. Class Members who complete and submit a valid claim form and Proof of Purchase will receive a redemption certificate with a face value of $365 that can be used toward an Acer, Gateway, or eMachines replacement computer and/or accessories or be exchanged for $62.50 cash.
Regardless of which benefit you choose, you will not be required to return your original computer.
The only way to receive benefits from the eMachines class action settlement is to submit a claim form postmarked by July 15, 2013.
A Final Fairness Hearing is scheduled for March 25, 2013.

Received a remanufactured Gateway SX2370-UR13 from the agreement. It is dead on arrival. Certainly dodn’t want to seem ungrateful but who said this was manufactured? This whole thing about getting used equipment is strange. Will have to work through the warranty process and hop for the best
Well the NEW Gateway desktop I got in early August, it would appear the hard drive died on friday, the recovery disks I bought for $21 didn’t work, so I shipped it off to Acer Repair in Temple Tx. Cost only $17+ to ship it Fedex ground 1400 miles. They say they’ll fix it and return it free as it’s under warranty. Keeping fingers crossed….
@alenka…ok. I just don’t see a major corporation revealing such seemingly confidential information to phone callers but I get your point. Maybe you should call the same number as the person you are referring to from a previous post and ask them your questions. See if they answer you.
lots of people involved in this. Somebody in previous comments said there was a telephone # where you can speak to a person. May be somebody went ahead and asked some questions.

@alenka…I just have to ask you something in response to your question below. How in the world is anyone going to answer that? I just don’t understand how you might think a consumer on this forum would know this information or be privy to it. Thanks…just curious why you would think anyone can answer you unless I missed something here.

I sent in my certificate (EDITOR’S NOTE – DO NOT PUT CLAIM OR CERTIFICATE NUMBERS IN YOUR COMMENTS! TOP CLASS ACTIONS IS NOT A SETTLEMENT ADMINISTRATOR AND CANNOT ADVISE YOU ON THE STATUS OF YOUR CLAIM!) on 8/26/13 with my pen number and ordered a Gateway computer with a 17.3 screen. I have heard nothing since. My certificate was worth $365.00 and my computer that I ordered was 349.99. Please check on this and email me back at the above email address.
I sent in my claim form in June. Tomorrow is Oct 1st and I still haven’t heard back from them (i.e. NO certificate, no explanation of why no certificate, etc. I called the phone number, but it is an auto list of common questions and says if you don’t get your certificate by Oct, your claim was disallowed. On what grounds? – they contacted me to tell me they owed me this certificate and now – nothing? . So now what do I do? Is there any phone # where I can speak to a human?
I just got my letter today 9/29 I sent my card in about a week b 4 the due date
