UPDATE: A federal court approved the eMachines Computer Class Action Lawsuit Settlement at the Final Approval Hearing. Class Members have until July 15, 2013 to file a claim. A proposed class action lawsuit settlement has been reached over allegations eMachines sold defective computers. If you purchased an eMachines computer, you may be entitled to a replacement computer, accessories or $62.50 in cash if the class action settlement is approved.
The eMachines settlement will resolve a class action lawsuit, titled Stroud v. eMachines Inc., that alleges the defendants sold computers with a defective part that could cause the loss or corruption of data written to, or read from, a floppy disk. eMachines denies any wrongdoing but has agreed to a class action lawsuit settlement to resolve the litigation.
Class Members of the eMachines computer class action settlement include anyone who purchased the following computers from eMachines or an eMachines authorized reseller (a retail store) in the United States on or after December 31, 1997:
Class Members have the option to receive a replacement computer and/or accessories or a cash payment. Class Members who complete and submit a valid claim form and Proof of Purchase will receive a redemption certificate with a face value of $365 that can be used toward an Acer, Gateway, or eMachines replacement computer and/or accessories or be exchanged for $62.50 cash.
Regardless of which benefit you choose, you will not be required to return your original computer.
The only way to receive benefits from the eMachines class action settlement is to submit a claim form postmarked by July 15, 2013.
A Final Fairness Hearing is scheduled for March 25, 2013.

I sent in my claim about one week before the cut off line but was definitely postmarked in time. I still haven’t received my certificate.
sent mine in february haven’t received it yet, my friend got his he purchased two computers and paid the difference shipping was quick within a week by UPS, it is NOT a scam some people just dont press the certicate credit button “FIRST” then it shows the difference you have to pay with a credit card, Laptop ok but it wont burn dvds but it does read them…no compliants here
@MontanJim72: No scam here for me! I love the tablet I got. If you are worried about using your credit card then make it a point to not order anything on the website over the allotted certificate dollar amount. Mine cost $329 and so I never had to expose my credit card number. I use my tablet constantly and did not initially think I would at all! It has fast replaced my older regular laptop. I understand your skepticism for I was like you, too, at first but man oh man am I glad I decided to trust it and go ahead with it. Take the ball and run with it is what I say. Lucky us for sure.
It’s interesting that the lawsuit listed above is called Collins v. eMachines Inc., yet the letter I received is called Stroud v. eMachines, Inc. This was on my redemption certificate. I will be calling my state consumer protection agency tomorrow. I’m pretty sure this is a scam, but i might try to make them pay the $62.50 in cash to see what happens. Given all the problems I have seen below, it has to be mostly a scam, although some people seem to have gotten lucky. Anytime credit cards get charged, even “accidently”, it’s a scam.
@Tonya…I spoke with someone live very easily. I called the 800 number just to find out more…very nice guy. The tablets are brand new on the website…far better choice than the $62 although I’m sure you will find good use for the cash. Be grateful…we are lucky to be a part of this reimbursement suit. Were it not for some wealthy litigant bringing complaints forward it may not have happened at all and we would have zero.
Has anyone received the $62 check? With the refurbished computers, bad packing and overcharging people’s credit card, I decided to take the $62. I agree with the other comments, it feels like we’re being screwed again. The only winners here are the lawyers. Can’t even a live person on the phone if you have a complaint.
@Penny…thanks! And I indeed feel blessed…I have other computer brands and had them in the past that were horrible, too, but never got the opportunity to get a freebie out of it whether brand new or refurbished. So indeed luck is on our side with our past emachine purchases! Good luck to you!

Nope…our e-machine was a constant problem. I have been on the site several times and everything is refurbished. I am happy you are happy. No tablets left and I don’t need a tablet.

Penny–ripped off by who? We are extremely lucky to be a part of this class action suit! Probably for most of us our original emachines worked fine but we still got lucky in the end. I used my certificate to get the BRAND NEW YES BRAND NEW NOT REFURBISHED TABLET. Totally love it and definitely feel blessed!!
