UPDATE 11/12/13: eMachines Extends Cash Option Deadline for Class Action Settlement

UPDATE: A federal court approved the eMachines Computer Class Action Lawsuit Settlement at the Final Approval Hearing. Class Members have until July 15, 2013 to file a claim. Distribution of the Settlement Awards will be made in the fall of 2013. See how to file a claim for the eMachines Computer Settlement.

 

A proposed class action lawsuit settlement has been reached over allegations eMachines sold defective computers. If you purchased an eMachines computer, you may be entitled to a replacement computer, accessories or $62.50 in cash if the class action settlement is approved.

The eMachines settlement will resolve a class action lawsuit, titled Stroud v. eMachines Inc., that alleges the defendants sold computers with a defective part that could cause the loss or corruption of data written to, or read from, a floppy disk. eMachines denies any wrongdoing but has agreed to a class action lawsuit settlement to resolve the litigation.

Class Members of the eMachines computer class action settlement include anyone who purchased the following computers from eMachines or an eMachines authorized reseller (a retail store) in the United States on or after December 31, 1997:

Class Members have the option to receive a replacement computer and/or accessories or a cash payment. Class Members who complete and submit a valid claim form and Proof of Purchase will receive a redemption certificate with a face value of $365 that can be used toward an Acer, Gateway, or eMachines replacement computer and/or accessories or be exchanged for $62.50 cash.

Regardless of which benefit you choose, you will not be required to return your original computer.

The only way to receive benefits from the eMachines class action settlement is to submit a claim form postmarked by July 15, 2013.

A Final Fairness Hearing is scheduled for March 25, 2013.

    I am the only one that fines this settlement a sham? We get to use our certificate for a refurbished computer? Why not towards any (which is what I thought would be in the works) new one of our choice from a list…

    I think I’ve been ripped off by the lawyers again!

    Alenka…the 8.1 is absolutely the perfect size believe it or not! Bigger than smartphone and smaller than a bulky laptop or larger tablet. Fits perfect in one hand, easy viewing. I cant believe i would love it as much as i do..i too thought it would be too small at first but boy oh boy was i ever surprised. Totally love it and dont want a bigger size! be careful of refurbs…they are used and u are taking a risk. Avoid it if u can.

    got my certificate long time ago, but still waiting to see, looking for a tablet. They had new ones 8.1″, but was too small for me, not too much bigger than a smartphone. Usually if item is refurbished, it should work the same as a new one does and last for a long time. And I think if it comes with a cracked screen or broken, they have to replace it. Hope they have better selection 2 or 3 months from now.

    I have returned the item and I am waiting on a replacement. Secondipity said it would take 7-10 business days before I receive a new tracking number for the replacement item. The process, while not painless, wasn’t as big of a hassle as I thought. It required photos of the packaging as well as photos of the machine. Customer service, while a challenge to contact, was helpful. If I have anymore issues I will be sure to post them here.

    Any update Chuck? I got an Acer 23″ AIO and had the same issue, but in the center top of the screen. I got mine yesterday and sent an e-mail. Customer service was closed. I got a response asking me for generic claims information and that I would receiving UPS labels in about 7 days after processing the claim. Seems they don’t know hot to pack the AIOs. Looked good other than the cracks!

    Hi Roy–which tablet did you get? Was it a refurb? I got the 8.1 brand new and it is entirely awesome! Which one did you get?

    i received my acer tablet and the damn thing isn’t working not even had for over a month , it was getting extremely hot the charger also im so upset!!

    I have lost me settlement notice. Is there a way to find out how to obtain a copy of it?? Please help I would like to buy a new computer and use this towards a new one

    Mailed in card with ID last June. Awaiting certificate. Is there anyone we can contact to check on claim status, and possiable date the certificate will be sent?
