A grieving pet owner has filed a $5 million class action lawsuit against Nestle Purina and Wal-Mart, claiming his dog died after eating Waggin’ Train “Yam Good” dog treats.

Dennis Adkins claims in the Nestle Purina class action lawsuit that he purchased the Waggin’ Train brand treats from Wal-Mart in March and fed the chicken jerky treats, which are made in China, to his 9-year-old Pomeranian. After three days of eating the treats, his dog became sick. She later died of kidney failure 11 days later.

“Waggin’ Train has spent millions of dollars in promoting trust and confidence among consumers in its pet food products,” Adkins says in the class action lawsuit. “The product was not wholesome, was not nutritious and was unhealthy.”

Adkins says he didn’t give the dog more than the recommended one treat per day, and that, other than feeding her the treats, he didn’t change her diet. He also says his other dog did not eat the treats and did not get sick.

This is not the first time that Chinese-made chicken jerky treats have come under fire.

The Food and Drug Administration has been investigating a possible link between dog illnesses and chicken jerky treats made in China since 2007, and has urged pet owners to use caution when feeding dogs these products.

The latest warning came last November when the agency warned consumers that some pet owners and veterinarians have reported cases involving dogs falling ill after eating Chinese-made chicken jerky treats. While most dogs have recovered, some deaths have been reported.

According to the FDA’s website, the illness affects the kidneys, and symptoms include decreased activity, vomiting, diarrhea and increased water consumption and urination.

None of the products were recalled, and no specific brands were mentioned in the FDA warning.

In light of these repeated FDA warnings, Adkins says Nestle Purina and Wal-Mart knew that the dog treats posed a substantial health-risk to pets yet still manufactured and sold them. He alleges Nestle Purina knew of more than 500 cases of pets falling ill after consuming chicken jerky treats imported from China.

“Thousands of persons purchased the dog treats at issue, and hundreds of dogs died as a result,” Adkins says in the class action lawsuit.

He is seeking compensatory and punitive damages for a proposed class of anyone who bought Nestle Purina or Waggin’ Train-brand dog treats containing chicken imported from China in the past four years, and a sub-class of those who made the purchases from Wal-Mart.

The seven-count class action lawsuit claims breach of warranty, unjust enrichment, negligence, product liability and failure to warn.

    I just lost my Frasier (yorkshire terrior) 6/17/13 with exactly the same problems. Within 10 days of his first symptoms, he was at the vet daily, then hospitalized and continued getting worse. Did EVERYTHING we could to help him, spent thousands for them to help him, only to lose my baby boy. The pain for me isn’t getting any easier with time… I miss him with everything in me…

    I gave them to my dog and he bled from the rectum and was violently ill. He had to go to the Vet and take antiobiotics. It took him a few weeks to recover.

    I’ve fed my dog these for a while,then he began itching, I stopped giving them to him it took a long time but he seems ok noe. Keeping my fingers crossed

    My dog joe received the treats in early november. he begain having sezures.I had no idea that these treats were poison.I have spent over 3500.00 on vet visit. THESE PEOPLE ARE VERY,VERY EVIL !!!!!!!!!!!!

    Our Min-PIn developed Fanconi syndrome from the wagon train chicken jerky treats, its been 1 year now and she still has to go to the Vet every three months to get tested a urine test($250.00 per test) She still has it syndrome but it is controlled, for now. Our medical bills are over $3000.00

    Our dog, Indigo, received the treats in November as an early xmas gift. She began having seizures soon there after. I had no idea that these treats were poisonous. She has continued to have seizures. I know that this is what is causing the problem. How do we sue these bastards? She will probably continue to have seizures forever. She has them in bouts of 7 a day, and up to 9. She is now on prednisone and hopefully we will be able to combat this. They are evil.

    My 2 yr old German Shepard Nika has just in the last couple days started urinating on the carpet and having problems urinating outside. Please don’t be what I think it may be. I fed these to her often for her first year and a half. She had as many as 4 or 5 a day. More than what the bag said to give, but I thought being an 85lb dog that she could have a few more. I used them in training her. Feeling sick to my stomach now.

    I just lost My Atlas last week. He too was given the wagontail chicken treats. He became very ill afterwards ( fever 104 and vomiting iron count was low ) and I rushed him to the vets. She knew or heard something about it but couldn’t say much about it. Right after that, he started his head shakes. In Jan.2013 he started grandma seizures. His seizures finally took him last Wednesday. He was only 10 months old. I got mine at Dollar store with coupon on it. Duck and chicken flavor. R.I.P Atlas Mommy loves you!!!! :'((

    My adorable Chesapeake Bay Retriever pasted 04/04/2013, she was eight. I was in CA celebrating my Granddaughters Birthday’s early March. My sister comes to the house to care for Chessie when I am away. She noticed how lathargic she was. I remembered the last time I went to Wal Mart to buy Waggin Train the shelve was totally empty, went to another store same thing. March 21st I took Chess to the Dr. I lost her 14 days later. Chessie would not come in the house, she laid out on the cold ground. She had never done that ,Dog house or inside. I took her with me in the car, she could not stop panting, as if it were a hot summer day. From Easter Sunday to Thursday she must have gained 10 lbs all water,her front legs had doubled. As I sat on the ground with her crying she gave me a lick on the hand to console me, all the while her tail gently wagging. I have cried at work , in the car, on the phone, I lost a piece of my soul. My family members all cried, we will never forget our Chessie…no amount of moni can replace the unconditionale LOVE she gave to all our Family….pictures on facebook Denise Taylor
