A grieving pet owner has filed a $5 million class action lawsuit against Nestle Purina and Wal-Mart, claiming his dog died after eating Waggin’ Train “Yam Good” dog treats.

Dennis Adkins claims in the Nestle Purina class action lawsuit that he purchased the Waggin’ Train brand treats from Wal-Mart in March and fed the chicken jerky treats, which are made in China, to his 9-year-old Pomeranian. After three days of eating the treats, his dog became sick. She later died of kidney failure 11 days later.

“Waggin’ Train has spent millions of dollars in promoting trust and confidence among consumers in its pet food products,” Adkins says in the class action lawsuit. “The product was not wholesome, was not nutritious and was unhealthy.”

Adkins says he didn’t give the dog more than the recommended one treat per day, and that, other than feeding her the treats, he didn’t change her diet. He also says his other dog did not eat the treats and did not get sick.

This is not the first time that Chinese-made chicken jerky treats have come under fire.

The Food and Drug Administration has been investigating a possible link between dog illnesses and chicken jerky treats made in China since 2007, and has urged pet owners to use caution when feeding dogs these products.

The latest warning came last November when the agency warned consumers that some pet owners and veterinarians have reported cases involving dogs falling ill after eating Chinese-made chicken jerky treats. While most dogs have recovered, some deaths have been reported.

According to the FDA’s website, the illness affects the kidneys, and symptoms include decreased activity, vomiting, diarrhea and increased water consumption and urination.

None of the products were recalled, and no specific brands were mentioned in the FDA warning.

In light of these repeated FDA warnings, Adkins says Nestle Purina and Wal-Mart knew that the dog treats posed a substantial health-risk to pets yet still manufactured and sold them. He alleges Nestle Purina knew of more than 500 cases of pets falling ill after consuming chicken jerky treats imported from China.

“Thousands of persons purchased the dog treats at issue, and hundreds of dogs died as a result,” Adkins says in the class action lawsuit.

He is seeking compensatory and punitive damages for a proposed class of anyone who bought Nestle Purina or Waggin’ Train-brand dog treats containing chicken imported from China in the past four years, and a sub-class of those who made the purchases from Wal-Mart.

The seven-count class action lawsuit claims breach of warranty, unjust enrichment, negligence, product liability and failure to warn.

    Lost a golden retriever after feeding him Purina’s made-in-china Waggin’ Train Jerky Tenders chicken strips (1 per day) for a few days.

    I would like to see all food stuffs containing ANY ingredients manufactured or processed in China clearly and boldly printed on the front labels of products sold in the United States.

    Purina has lost a customer as a result of their greed-driven need to place profit over quality and safety.

    august 25 2012, my 5 yrs old dog had to be put down cause he was he had kinney falure,we were giving him the waggin train yam treats and the jerky!Had no ideal how my dog got sick all of sudden? I would like to be place on this class action for ‘WAGGIN TRAIN’ THANK YOU DIANA CASTRO RIVERSIDE,CA

    please include me in the class action suit
    two years ago after i give my dog the waging tail chicken treat bought in walmart “i still have the bag” she feel ill from kidney failure , i suspected the treat to be responsible for her condition,i look up info about this treat and found out that over 50.000 dog died ,after eating these treats, and had been reported to the us government office.
    i called waging tail and let them know that there treat were more likely the cause of the kidney failure,i filed a claim with them and they give me a claim number,but they never follow up with me.
    after extensive health care my girl past away in march, so please make sure you include me in your lawsuit,you can use any of the information i posted here if you need it in your class action suit .

    You are more than welcome to use me to help with your lawsuit… We lost our Maddy almost 2 years ago from Kidney failure… She used to love the Wagon Train Chicken Jerky and we bought the big bags from Sam’s Club… When she was 2 years old we got a sibling for her a Yellow Lab… She also liked them… Both girls got abnormally high PLK Liver values and we suspended all of their treats… Maddy continued to have issues predominantly UTI’s due to abnormal Kidney levels… 4 years ago, her age 6 was her first Kidney Infection… Went a full year with constant testing and diet restriction then another severe event. Got her in to the University of Georgia Vet Center and went through a week of testing and getting her good enough to come home. Since Kidney’s don’t heal she was in stage 3 into Stage 4 Kidney Disease until we finally determined that her good days were not enough any more and decided it was time on January 23rd 2012… She was 8 years 3 months…

    I’ll spare you all of the details, but $24,000 in Vet bills over 2 years I have a hell of a document trail…

    Vomiting and loose stools were very common when she was younger and we were using these treats and as a first time pet owner, we were unaware that we were poisoning our little girl with these things…

    Do not feed this garbage to your dog!
    I had no idea why my shitzu would not eat this. And he is still living,
    He never liked it.
