A grieving pet owner has filed a $5 million class action lawsuit against Nestle Purina and Wal-Mart, claiming his dog died after eating Waggin’ Train “Yam Good” dog treats.

Dennis Adkins claims in the Nestle Purina class action lawsuit that he purchased the Waggin’ Train brand treats from Wal-Mart in March and fed the chicken jerky treats, which are made in China, to his 9-year-old Pomeranian. After three days of eating the treats, his dog became sick. She later died of kidney failure 11 days later.

“Waggin’ Train has spent millions of dollars in promoting trust and confidence among consumers in its pet food products,” Adkins says in the class action lawsuit. “The product was not wholesome, was not nutritious and was unhealthy.”

Adkins says he didn’t give the dog more than the recommended one treat per day, and that, other than feeding her the treats, he didn’t change her diet. He also says his other dog did not eat the treats and did not get sick.

This is not the first time that Chinese-made chicken jerky treats have come under fire.

The Food and Drug Administration has been investigating a possible link between dog illnesses and chicken jerky treats made in China since 2007, and has urged pet owners to use caution when feeding dogs these products.

The latest warning came last November when the agency warned consumers that some pet owners and veterinarians have reported cases involving dogs falling ill after eating Chinese-made chicken jerky treats. While most dogs have recovered, some deaths have been reported.

According to the FDA’s website, the illness affects the kidneys, and symptoms include decreased activity, vomiting, diarrhea and increased water consumption and urination.

None of the products were recalled, and no specific brands were mentioned in the FDA warning.

In light of these repeated FDA warnings, Adkins says Nestle Purina and Wal-Mart knew that the dog treats posed a substantial health-risk to pets yet still manufactured and sold them. He alleges Nestle Purina knew of more than 500 cases of pets falling ill after consuming chicken jerky treats imported from China.

“Thousands of persons purchased the dog treats at issue, and hundreds of dogs died as a result,” Adkins says in the class action lawsuit.

He is seeking compensatory and punitive damages for a proposed class of anyone who bought Nestle Purina or Waggin’ Train-brand dog treats containing chicken imported from China in the past four years, and a sub-class of those who made the purchases from Wal-Mart.

The seven-count class action lawsuit claims breach of warranty, unjust enrichment, negligence, product liability and failure to warn.

    I to am heart broken and I feel a total loss. My 8 year old Pomerania was my baby boy. He loved the waggin train jerky treats, the PB& J biscuit treats, the sweet potatoe wrap jerky treats. I would have never given them to him had I known they would cause my baby boy to leave me. He’d had these treats for years and I felt safe with them because he loved them. Thanksgiving Day 2012, he woke up lethargic, and could seem to shake it. I was taking him outside and he fell over and couldn’t get up. I rushed him to an after hours weekend vet and they told me he had a dislocated disk. I got meds for him but didn’t start him I waited until the next day and we went to his regular vet. He told me he would start him on meds and he got the meds the other vet gave me and I gave him those meds he started to walk a little better. After a week he was okay, and started eating again. I continued his treats and he started getting lethargic, he was not active anymore he barely moved. He started to throw up and was losing control of his bodily functions I took him back to his vet to find out about the throwing up and the weakness he was seeming to have and they did blood work and found out he had pancreatitis. I was devastated and within 24 hours Christmas 2012, my baby was dead. I can’t bring him back but those that did wrong distributing treats that would harm my baby or anybody else’s baby deserves to be prosecuted by any means necessary. I am now letting anyone I know with sick pets to check their lists of treats to see if they had or still have treats. And report this too.

    his breaks my heart I have rescued five dogs I worked with animals for 20 years. I have some many dogs get deathly sick after eating these treats with out knowing why now I see why I also would give my dogs the chicken strips and did not understand why they would vomit,become sluggish and not hem self. I begged my boss to pull all treats from china and other tainted products he refused money was more of a motivater then saving his customers dogs life disgusted.I would like to be apart of this class action lawsuit it means a lot to me to boycott things not made in USA.I cried every time I see someone lose the family member do to negligence of greed for money.

    We just lost our precius Schnauzer “Holly” on Feb. 19th 2013. We fed her only the best food and she has been eating the Jeerky Treats for a few years, which we thought was safe. she got 1 or 2 a day and loved them. She was in perfect health, then started with diareaha then vomiting. she got really sick on sunday nite throwing up constantly , took her to emergency vet, they did blood work and gave her meds for pain and throwing up. nxt day we took her to our reg. vet . They did exrays and found out everything was perfect, on her BUT she had a huge mass on her colon, long story short, she only was with us maybe 10 days after that.I am beside myself, this dog was my life

    i want to sue them cause of my dog died in 2 weeks time sick cancer and bleeding of his kinneys he would followme every where i go and if he knew i was in the house he open the door to come in with me just lay when i took to the vets it was so so sad he was a good dog he never complain of being sick he had hard tim to go to bath room when he did it would be black when he pee it was blood dr advised us to put him to sleep so he wouldnt suffer any more he was a very good dog he would even talk back to you he loved his daddy to every morning he jump up to couch and give kisses to him . he is so so missed we still cry. please help us they cant get away from this they should of never been sold and brody love them treets every time go to bathroom he was rewared he never let us know what it was doing to him untill to late .he was our baby we stop our other broulder collie she had to get pills to help her kinneys so far she is ok but our baby gone he was only 9 years old please help 724 352 0686 is our #

    well we went thru same thing we bought the wagon train jerky treats all the time company even sent us coupons to use we bought so many. Our poms got to vomitting n loose stools and spitting there water back up n laying lifeless and just wanting to sleep alot n once a friend told me about this and before this I went to Walmart in Cambridge oh. to purchase some the employee was opening up huge boxes n out on shelf he stockd them got up to register then cashier rang it up said hum we cant sale you this must be recall I said well you better recall that employee to box them back up he has out n other people purchasing them too..wonder how many got by with them she said well he will ck his email I said how often he do that. It maybe a lil late for him n you guys cause if something happens to my dogs I will come n go all Hitler on you people I got sick and worried they had been vomitting, loose stools n all laying around lifeless..so they need sued for this is not the first time from what I’m reading on here…..

    Well we have 2 poms and we had been buying these Wagon train treats n we even got coupons from the company for money off on the packs…and I went to buy them at Wal-mart and the employee had a buch od huge boxes opening these treats the chicken jerky like we bought and was stocking the shelf so I proceed to checkout and cashier said oh we can’t let you have these I said well no I was gonna buy them she said you can;t for some reason its telling not for sale maybe a recall I said well you better re-call that employee he is stocking them shelves back there they passed it off like well when he reads his email he will get it …huh I said well he may not read that till late n how many people may have bought some before you even caught it? I said if something happens to my dog I will come in here and go all hitler on you people cause my poms are my kids and if u know theres a recall why let that employee continue stocking shelves when you can stop him doing useless work! Well get my point they were no more concern’d bout me npr my pets but gholly they have it cause my dogs did vomit and have loose stools luckily I had antibiotics from the vet to give them wondering what was going on cause other then them treat they are fed kibbles n bits dog food…so I am really upset and a friend told me bout this on fcbk and its awful…!

    my dog biscuit died right before christmas it was horrible to see him progress so quickly from less active to laying around morning came he had lost all fuctions bowels urinating couldnt stand unbelieveable how he must of suffered he was my baby boy cocker spaniel 7 yrs old no warning within 24 hrs he was gone

    I thank you people really need to check your self before blaming this on wagon train. I have been feeding 3 dogs of mine for pass 8 years these chicken treats and there just fine. How are you going to say there treats are causing dog death when its unproven in not only the USA but the whole world. There a world wide company you would thank if dogs where dying it would be dogs from other country also. Just because someone was trying to cash in doesn’t mean everyone els should follow I mean everything on here has nothing to do with the main illness clams. Heres a real life story I know these people who are vegetarian and so they made there dog one its so sad, but anyways there I want to say 5 year old dog ate some hamburger once when it got lose after going over to a neighbors bbq. The dog almost died from eating meat due to the fact it had never had any in its life. The same can be said with seafood or candy. So next time your dog gets sick O iI don’t know ask your self has it had anything its not suppose, has it been acting funny before you gave it the treats, or is it old or been around sick animals. By the way when my lab was a puppy I never fed it wagon train and it got sick from getting into the trash, eating dirt, eating poop, and being too hyper.

    I have fed my two dogs Lola and Luke Wagon Train for about 6 months now… Lola became very ill last week. After $295 dollars vet bill she was diagnosed with a gastro problem. I thought for sure she had bloat because that’s how she was acting. Thank goodness she seems okay now. Luke, well he has a lead lined stomach, he seems quite alright. But I will keep my eye on them more closely for the next couple of weeks.

    I hope I am finding this out soon enough, but after spending $1500+ on vet bills. First problem was bladder infection, then another one, then throwing up. Tomorrow I am going to go to the vet to have kidneys checked. I am also going to report to FDA, even though it is so much information to provide. Only found out about the recall from a friend on Facebook. Need to spread the word.
