The total fund for the federal DePuy ASR metal-on-metal hip implant lawsuit settlement is $4 billion, and people who have a qualified claim should be able to receive about $250,000 for a start. They may need to speak with their doctor to see whether or not they received the specific ASR model of DePuy hip implants. However, because many older men and women also suffered from other complications, there is a detailed model of damages that may be awarded.
The following sub-classes are eligible for reviews of their claims:
1) Re-Revisions: Any people who needed two or more revision surgeries can qualify for $150,000 for two and $75,000 for each additional procedure to repair any damage caused by the DePuy metal hip implant failure.
2) Major Complications: For pulmonary embolisms by DePuy patients suffered during the procedure, the amount is $30,000; for deep-vein thrombosis a plaintiff can receive $15,000; dislocations that occur make claimants eligible for between $15,000 and $50,000 as a result of hip replacement complications; foot drop and other issues range from $10,000 to $15,000 depending on the level of severity.
The number of people who have had issues regarding delayed recovery, heart attack, stroke and death will be subjected damages that can vary greatly. For example, people who had a heart attack could receive an increase in their total award of between $66,000 and $360,000 depending on their age and how severe the infarction was. Age can also can also affect damages in the other conditions, as well.
DePuy Orthopaedics has been hit with thousands of metal on metal hip implant lawsuits by patients alleging that the DePuy hip implant product has lead to serious adverse side effects, which was supposed to be safer than older, more traditional products used for hip replacement surgery — leading several DePuy hip implant patients to have to undergo hip revision surgery.
The DePuy ASR Metal Hip Lawsuit Mass Tort is In re: DePuy Orthopaedics Inc. ASR Hip Implants Products Liability Litigation, MDL No. 2197, in the U.S. District Court for the Northern District of Ohio.
