BMW AG and BMW North America LLC have reportedly agreed to settle a class action lawsuit alleging the N63 engine in some of its vehicles caused excessive oil consumption.

The proposed BMW engine defect settlement will resolve a class action lawsuit filed by plaintiff Joon Bang and others in September 2015. They accuse BMW of concealing a defect in its N63 engines that allegedly causes vehicles to consume excessive amounts of oil and drain vehicle batteries.

BMW sought to have the oil consumption class action lawsuit dismissed, but its request was denied in late 2016.

According to the BMW excessive oil consumption class action lawsuit, the alleged BMW engine defect could put drivers and passengers at an increased risk of accidents. No accidents or injuries were documented in the complaint; therefore, it is possible for Class Members who claim they suffered injuries or other damage related to the alleged engine defect to bring claims for personal injury, wrongful death and/or property damage.

The BMW defendants deny any wrongdoing but they agreed to settle the engine defect class action lawsuit to avoid the time, expense and uncertainty of ongoing litigation. The BMW settlement documents did not provide an estimated value for the deal. However, the plaintiffs’ attorneys say the class action settlement will provide Class Members with benefits that would equal or surpass the amount they could have received if the case had gone to trial.

Class Members of the proposed BMW settlement includes anyone in the United States who purchased or leased a model year 2009 through 2014 BMW 5 Series, 6 Series, 7 Series, X5 or X6 vehicle with an N63 engine.

Under the terms of the proposed BMW engine defect settlement, Class Members are entitled to a free battery and $75 per oil service for up to three future oil changes. They will also be provided with a voucher worth $1,000 to $1,500 off a new BMW vehicle.

Some drivers may be eligible for reimbursement for expenses related to the battery and oil consumption issues, if they are able to provide receipts or other documentation of the costs. Drivers who meet specific conditions may be able to recoup at least some of the expenses they faced to replace the vehicle engine after multiple repair attempts.

    Im getting the engine replaced they are charging me 4000 for the replacement thats supposely 30% of total cost that im required according to the settlement . Also charging me 1550 for a coolant water valve and the reservior for cooland that are on ebay for about 50 dollars each but they wont take anything else . Fine upset and all im stuck with no choice but to spend more money on a vehicle i bought 4 years ago with the issue from day one and half the miles when i first took it to the dealer with this problem . But now is when they figure it out after i have spent over 15000 dollars going to different shops trying to resolve the problem the entirety of me owning this vehicle that no one want to trade or buy including bmw.
    Worse thing i have done in my life thousands in repairs . Oil consumption a quart every 4 days plays 10 miles per gallon . Crazy . I hate bmw i hope they dissapear from earth.

    I have a 2013 X5 (twin turbo) that I purchased used in 2015. In that time I’ve have 2 coolant leaks and 1 (possibly 2) oil pan leaks. In March
    I took my car to the dealership they acted like I did something to cause the engine malfunction. I’ve done everything my BMW service advisors told me to and now I’m stuck with an inoperable vehicle

    Can someone please tell me how to file a claim ASAP? We just bought. 2021 BMW X5 three weeks ago from a non BMW dealership and it has been in the shop theee times now. We brought it in yesterday for burning oil smell and the engine oil light came on. They told us today about this issue with BMW and pretty much sent us on their way because it’s not their problem. Now we are stuck with a car we have had for three weeks that has a major problem and the deadbolt to file is in two weeks. I tried to file on mine but it keeps asking me for a claim number which I obviously don’t have.

    I wrote this on another reply but seems the reason the dealer considers this business as usually while a normal person couldn’t possibly think this is normal.
    It seems to be across the board! I have the same 2012 550XI. Has been in the shop multiple times for turbo leaks, crank shaft leaks and also had turbo replaced. Just went out of warranty for time (not mileage) and the latest visit is asking for the other turbo to be replaced, crank shaft lines and oil lines to be replaced. I also had a 3 cylinders misfire. The response from the dealer is that I am due soon for new spark plugs so it will “fix” the issue, although the cause is the oil leaks…. It has become a farce but they seem to still stand behind the nonsense.

    I’m not sure it’s a good idea to be included because the settlement. It doesn’t mention anything about the burning oil vapors that get into the car through the AC. You could develop cancer later because you drove around in the overpriced oil kettle and now BMW is out in the clear and the compensation is not worth anything to anyone over 80k miles. BMW refuse to do service packages all the time and the lawyers just wanna get paid and once that happens they won’t even talk to you. Better to sue them for more later?

    My 2012 550 is in shop now with a local dealer. They want $2600 to replace one injector and some hoses, vapor lines, o rings. Same problem with injectors they replaced in 2014 under warranty.

        I’m going through the same thing, but I got my engine rebuilt and shortly after my repair it misfired. The cost to replace spark plugs are $300.00 each.

    I have been included in this class action suit and Lord i hope this goes through. I took my car to BMW and actually was told i needed a new engine all together on my 2011 BMW 550i that is only 7 yrs old.

        Wrote this under another comment as well but seems to be a common thing. It is probably why something that seems so outrageous to a normal person is business as usually when it is brought to the dealer.

      Hi. Can someone please tell me how to file a claim and get in on this ASAP? We just bought a 2011 BMW X5 a few weeks ago from dealer and it has been in the shop three times already. They just informed us today about this issue and basically just sent us out the door as they are not a BMW dealership so they don’t believe it is their problem. We are just devastated and are trying to get the dealer to take the car back.

    What about a 2013 X3 that needs a
    New Turbo-Charger due to a problem with the oil/air mix from the oil lines. Damage may need to a new engine needed.
