BMW, Porsche telematic features class action lawsuits overview: 

  • Who: Peter Grayson filed separate class action lawsuits against BMW of North America and Porsche Cars North America. 
  • Why: Grayson separately claims BMW and Porsche misrepresented the telematic systems in certain of its vehicles since they allegedly are only compatible with 3G technology and have been rendered inoperable with wireless carriers dropping it. 
  • Where: The class action lawsuits were filed in New Jersey federal court. 

Certain older Porsche and BMW vehicles will no longer be able to perform telematic features due to wireless carriers dropping 3G technology, a pair of new class action lawsuits separately allege. 

Plaintiff Peter Grayson separately claims Porsche and BMW misrepresented the vehicles telematic systems by not informing consumers they would be rendered inoperable in the event wireless carriers dropped 3G technology. 

Grayson argues the telematic systems manufactured into the affected Porsche and BMW vehicles were only temporary on account of them allegedly only being compatible with 3G technology. 

“The Class Vehicles’ internet enabled telematic features such as roadside emergency safety features were rendered inoperable after the 3G phase out in 2022 due to defendants’ use of obsolete telematics equipment they installed in the Class Vehicles,” states the BMW class action and Porsche class action. 

Porsche and BMW being asked to provide compensation for telematic systems allegedly ‘rendered inoperable’

Grayson wants to represent nationwide classes of consumers who have purchased either a BMW or Porsche vehicle containing telematics systems that are only compatible with 3G technology. 

“This action was commenced to obtain recompense for Class Vehicles whose telematics were rendered inoperable when 3G was phased out, or repair, retrofit or replacement of 3G telematics,” states the BMW class action and Porsche class action. 

Porsche drivers will no longer be able to access their vehicles’ “Porsche Connect” features due to the phase out of 3G, while BMW owners will be unable to use their “Connected/Drive BMW Assist” systems, according to the BMW class action and Porsche class action. 

Grayson separately claims Porsche and BMW are guilty of unjust enrichment and in violation of New Jersey’s Consumer Fraud Act, breach of express warranty in violation of a New Jersey statute, and the Magnuson-Moss Warranty Act

Plaintiff is demanding a jury trial in both complaints and is requesting an award of actual damages for himself and all class members. 

A separate class action lawsuit was filed against BMW in June over claims the company exaggerates the driving range for some of its i3 passenger vehicles when they are being driver in cold weather.

    I purchased a 2017 Porsche Macan GTS with the Porsche Connect and 6 months later Porche connect cut off. If they had told me there would be a problem with my Porsche Connect I would not have purchased that model. It was purchased with the certified warranty and the claim it is not covered because of 3g. Very disappointed.

    Have a 2015 BMW 328i drive GT. Was very disappointed to have paid for services that are no longer available. Would not have bought had I known because I need and rely on the services that I paid for. Seems to me as if it is a breach of contract/misrepresentation of goods/fraud.

    I have a 2016 x4. BMW knew that 3g was being fazed out prior to building 2015 and newer vehicle. Instead of installing 4g which was available in 2015. They installed outdated communication boxes. I asked BMW about updating the comm box and they stated that they do not offer the upgrade, even though it is a simple procedure. I paid quite a bit extra to have this tech that no longer functions because they knowingly installed outdated comm boxes. I used the app and the features all the time, now I cannot. I reiterate, they were told by Verizon, ATT and T-moble and feds that the 3g was being phased out, but they installed outdated comm boxes anyway. They need to make this right especially after taking our money for the obsolete equipment and also charging us yearly fees to have access.

    I have a 2015 BMW 328i and have the MyBMW app on my phone and I use to be able to locate my car at anytime. The car was stolen once and I tried to open the app to locate my car and was not able to anymore. So, I called the BMW assist number and was told that my car is out of date and I that it’s time for me to upgrade to a newer model.

    I own a 2015 bmw 328 i xdrive and while emptying my car i closed the door while my key was accidentally placed on the back seat amd the doors was locked while my son was still in the car. I went to open the MyBMW app and was no longer able to unlock my doora from the app i called BMW assist and they stated my car is out dated and they are also un able to unlock my door

    I have a 2014 BMW X-5 where the 3G has been discontinued and therefore have lost a valuable safety feature.

    I have a 2014 740i which has inoperable telematics and was not included in the retrofit. I used the services extensively and can no longer. Have tried several times but to no success.
