BMW AG and BMW North America LLC have reportedly agreed to settle a class action lawsuit alleging the N63 engine in some of its vehicles caused excessive oil consumption.

The proposed BMW engine defect settlement will resolve a class action lawsuit filed by plaintiff Joon Bang and others in September 2015. They accuse BMW of concealing a defect in its N63 engines that allegedly causes vehicles to consume excessive amounts of oil and drain vehicle batteries.

BMW sought to have the oil consumption class action lawsuit dismissed, but its request was denied in late 2016.

According to the BMW excessive oil consumption class action lawsuit, the alleged BMW engine defect could put drivers and passengers at an increased risk of accidents. No accidents or injuries were documented in the complaint; therefore, it is possible for Class Members who claim they suffered injuries or other damage related to the alleged engine defect to bring claims for personal injury, wrongful death and/or property damage.

The BMW defendants deny any wrongdoing but they agreed to settle the engine defect class action lawsuit to avoid the time, expense and uncertainty of ongoing litigation. The BMW settlement documents did not provide an estimated value for the deal. However, the plaintiffs’ attorneys say the class action settlement will provide Class Members with benefits that would equal or surpass the amount they could have received if the case had gone to trial.

Class Members of the proposed BMW settlement includes anyone in the United States who purchased or leased a model year 2009 through 2014 BMW 5 Series, 6 Series, 7 Series, X5 or X6 vehicle with an N63 engine.

Under the terms of the proposed BMW engine defect settlement, Class Members are entitled to a free battery and $75 per oil service for up to three future oil changes. They will also be provided with a voucher worth $1,000 to $1,500 off a new BMW vehicle.

Some drivers may be eligible for reimbursement for expenses related to the battery and oil consumption issues, if they are able to provide receipts or other documentation of the costs. Drivers who meet specific conditions may be able to recoup at least some of the expenses they faced to replace the vehicle engine after multiple repair attempts.

    550i. Multiple problems. Constant drivetrain malfunction, rough idle,oil consumption, terrible MPG (10mpg or less on premium gas), battery issue,ignition coil issue. Please add me

    Since I bought my 750LI in 2012, I have had to add oil between fill ups. At first it was a quart every 1,000 miles. The dealership would top it off for me. But I travel long distances so now I carry a case of oil in my car trunk. I am adding oil every 500 miles and have been since I hit the 90,000. I think it is preposterous that on a 100,000 car I have to add that much oil.

    My 2011 750ix uses a quart of oil every gas fill up. This has been going on since i bought the car and was told its because of the turbos. Well now the dealer says my turbos are going bad at $3500 each. Most likely due to being run on low oil so many times each time they overheat and it has caused them to go bad for $7000. I also replaced all the coils and both banks of injectors. Anytime i get rom above 5k the drivetrain not available warning comes on. This is a 100k car and I like the comfort of it but i have never if had this many issues with a vehicle. Please add me to the class action list. I hope it pays for the engine problems, oil leaks, turbos and b.c. whatever else could be caused by an engine running low on oil hundreds of times throughout its life.

    Yes add me too. I have a 2012 BMW X5 50i with a serious oil consumption problem. I have brought my BMW in at least 4-5 times for an oil light/leak costing anywhere from $3k-over $5k each time and thank god it was under warranty and extended warranty for most of those times. But lets take in the time consideration. Also the extended warranty company should be compensated as well. I also had to buy a CASE of oil from Peake BMW dealership because oil light would come on every 1-1.5-2 months and they told me to just top it off with a thing of oil. SURE! That always sounded fishy to everyone EXCEPT the BMW dealersh, op of course. So, the 4th or 5th time I brought my car in and complained that I should not have to keep bringing my car in for oil leaks. Their response was that there are 8 places the engine could leak. So, I was like oh I guess I have at least 3 more times to bring it in. UNBELIEVABLE!! The $1500 car voucher is CHUM CHANGE. My car is $100k, what the hell am I going to get with $1500, an oil change??

    I check my gasoline and fill my oil on a regular basis . I had an oil gasket replacement and the Bmw X5 5.0 , consumes 2 to 3 quarts between fill ups . I told Bmw and they said its normal because its a twin turbo engine . Don’t get me wrong I love my Sav but Bmw needs to make things right and move on .

        I have the same car X5 50i and I have the same problem. Serious oil consumption and you can’t see if it is leaking because there is a cover underneath.
