Do you (or did you) own or lease a model-year 2009-2014 BMW 5 series, 6 series, 7 series, X5, or X6 vehicle equipped with an N63 engine? You may be eligible to participate in a class action settlement resolving claims the engines consume excessive amounts of oil.

The BMW oil class action was originally filed in September 2015. The group of plaintiffs who filed the case argued that BMW concealed an engine defect which allegedly causes vehicles to consume excessive amounts of motor oil, requiring additional oil changes and the need for adding engine oil between regular oil changes. They further allege the defect causes substantial battery drain, potentially causing premature battery failure.

BMW has denied any wrongdoing in the case but agreed to settle the class action lawsuit to avoid future costs of litigation. Although the settlement proposal did not provide an estimated amount for the settlement fund, plaintiffs’ attorneys said Class Members will receive compensation equal to or greater than what they would have received if they won at trial.

Under the BMW oil class action settlement agreement, eligible Class Members are entitled to a number of benefits, including free future oil service and/or reimbursement for past oil services, reimbursement for towing/rental/roadside-assistance service, and/or reimbursement for a battery replacement.

Class Members have until Aug. 23, 2018 to exclude themselves from the settlement fund and until Oct. 10, 2018 to submit a valid claim. The final approval hearing is set for Sep. 10, 2018.

Who’s Eligible

Class Members include consumers and entities in the United States or Puerto Rico who currently own or lease, or previously owned or leased, certain U.S. specification model-year 2009-2014 BMW 5 series, 6 series, 7 series, X5, or X6 vehicles equipped with an N63 engine purchased or leased in the United States or Puerto Rico.

The following vehicles are covered by this settlement:

  • 7 Series Sedan (F01 & F02), model years 2009 to 2012, produced from 3/2009 to 6/2012
  • 7 Series Active Hybrid (F04), model years 2010 to 2013, produced from 4/2010 to 6/2012
  • 5 Series Gran Turismo (F07), model years 2010 to 2012, produced from 9/2009 to 6/2012
  • 5 Series Sedan (F10), model years 2010 to 2013, produced from 3/2010 to 7/2013
  • 6 Series Convertible (F12), model years 2011 to 2012, produced from 3/2011 to 7/2012
  • 6 Series Coupe (F13), model years 2011 to 2012, produced from 7/2011 to 7/2012
  • X5 SAV (E70), model years 2010 to 2013, produced from 3/2010 to 6/2013
  • X6 SAV (E71), model years 2009 to 2014, produced from 7/2008 to 6/2014
  • X6 Active Hybrid SAV (E72), model years 2009 to 2012, produced from 9/2009 to 9/2011
Potential Award

Class Members who submit a valid claim may be entitled to a number of benefits. The full list of benefits and their details can be found in the FAQ section of the settlement website.

Here is a very high-level breakdown of some of the benefits available, which vary depending on your vehicle’s model year and mileage, and if you have documentation:

  • Three free future oil services, up to $75 per service.
  • Free engine replacement.
  • Reimbursement of past oil services, up to $75.
  • Reimbursement up to $50 for the cost of one towing/rental/roadside assistance expense incurred.
  • Reimbursement for the cost of a replacement battery that was less than 3 years old.
  • Voucher worth $1,000 to $1,500 to be used on a new BMW vehicle.

Proof of Purchase

If Class Members are seeking compensation for additional oil or battery expenses, they must provide a copy of the relevant invoice and a copy of the receipt of payment. The invoice must contain the VIN, mileage, date of service, service provided, and amount due. More information is available in #6 of the settlement administrator’s FAQ page.

    I purchased my 2014 BMW X6 from a Nissan Dealer on June 27,2022. When I purchased my X6 the oil light indicator was on. Nissan sent my car to BMW and they had it for a week. No mention of the recall on the oil consumption class action settlement. I added many quarts of oil within the first year of my purchase and it continues to be an ongoing issue. In addition, the car smokes. The X6 has been in and out of BMW service shop on numerous occasions with no mention of the oil consumption problem. I need help.

    Bought a used 2011 550i back in March 2019 from a non-bmw dealer. The sales rep and mechanics assured me that the car was in tip top shape. Shortly after, I took the car to a bmw dealer for a routine oil change and for a liquid leak. Found out that the turbos seals needed replacing. The cheap 3rd party insurance refused to pay for the fix due to that there was already a class action suit for the issue and it was already paid out to customers. So I guess I missed out. Does anyone have info on new suits in regards to this turbo issue? This 550 is a money pit

        My 2011 X5 has 135K miles and needs a new engine and has a faulty high pressure fuel pump. I don’t have the $17K to fix and the dealership told me to call a salvage company!!

        What makes you think that. I have a 2013 550i. I just learned that the “customer care package” to solve this problem was performed in 2016 prior to me purchasing the vehicle. It was then done in Sept/Oct 2019 when I learned about the problem. I just brought the vehicle to BMW because I noticed a small amount of smoke coming out of tailpipe. They offered to let me pay about 6400.00 for another motor.

      I have a BMW M5 2013 north of America, he does not want to help me, the engine is damaged, there is an engine noise and now the Coolant is mixed with the engine oil

      My 2009 X5 4.8L has been serviced several times over the last 6 years an no mention ever of the recall/class action. Drinks a quart of oil a month, and on it’s 3rd battery. FMR!

      I am interested in joining the class action lawsuit too! BMW was purchased from BMW dealership 3.5 years ago with no mention of engine problems. I am scared to drive it for fear of the engine locking up…. the oil stays topped off, the smell of oil burning and smoking from the exhaust is more than I can bear. Please add me to the lawsuit. Too late for the lawsuit that closed in 2018

      Charles Woods: In June 2018 I purchased a 2010 BMW 750 LI. I have to keep putting oil in engine every week. I took it to a BMW Dealership in April of 2020. I was informed that there was a recall on certain engine parts. I was also told when I complained of the burning oil problem that there was a class action lawsuit on my vehicle that would have address the engine problem, but it had expired in February of 2020. I question why hadden I been contacted. I would have certainly taken advantage of the class action lawsuit had I been advised upon the purchase of my vehicle. Now after having the recalled portioned addressed , I am now faced with almost $16,000. 00 in labor, parts and taxes. Over $12,500 in labor alone. I could have save this expense in repairs had I been made aware of the lawsuit. Nobody notified me about the lawsuit or recall. I need help please.

        The only way i found out about the lawsuit was by a shop mechanic who shared the information. I did not receive any notice.

    I have a 2014 BMW X5 5.0i M Sport with the N63 engine that consumes 1 quart every 1000 – 1250 miles depending on driving style, outside temperature (if AC is used). Last year, I brought the vehicle to the BMW dealership when the vehicle was well within its warranty period, and they refused to repair or fix the car as they claim that BMW considers this type of consumption to be normal. The vehicle now has 72,5K on the odometer.
    Please let me know how do I can become party to the previously received settlement claim or if I can get the engine replacement option.

    Same for me too. I’m just seeing this site. I purchased my 750LI in 2015. Had it for a year, bringing it to BMW just about every other week because of the blue smoke coming out of the exhaust. BMW mechanics kept saying they didn’t see the smoke. After a year of bringing it to BMW, the engine seized on the parkway. BMW wanted $28,000 to replace the engine. My car has been sitting in the driveway since 2016 (4 years). My last car payment is next month. I had asked BMW to fix the engine for free in 2016 and they refused. I wish I had known about this Class Action Lawsuit when it was awarded. I will NEVER get another BMW.

    I have a 2010 BMW 750 Li XDrive 97k Miles I have to use 1qt of oil weekly I take it to BMW in Port land OR I payed $1295 for service and diagnostic they want to charge me 18k to fix the problem telling me I have an oil leak and a bunch of other problems I’m parking my car in the garage and I don’t see any signs of leaking oil on the floor the engine is a 4.4 any advice what can I do I think BMW lied to me about an oil leak ????????

      They told me the same thing about my 550i 2013 that I had a oil leakand I don’t believe them either cuz I have no oil leak on the ground what did you find out about the situation if anybody contacted you about the matter

        Hey Brian did you ever get your issue figured out my x5 is in bmw right now with the oil consumption issue my warranty won’t cover it because they said bmw should be paying for it because of this act let me know!!
