BMW AG and BMW North America LLC have reportedly agreed to settle a class action lawsuit alleging the N63 engine in some of its vehicles caused excessive oil consumption.

The proposed BMW engine defect settlement will resolve a class action lawsuit filed by plaintiff Joon Bang and others in September 2015. They accuse BMW of concealing a defect in its N63 engines that allegedly causes vehicles to consume excessive amounts of oil and drain vehicle batteries.

BMW sought to have the oil consumption class action lawsuit dismissed, but its request was denied in late 2016.

According to the BMW excessive oil consumption class action lawsuit, the alleged BMW engine defect could put drivers and passengers at an increased risk of accidents. No accidents or injuries were documented in the complaint; therefore, it is possible for Class Members who claim they suffered injuries or other damage related to the alleged engine defect to bring claims for personal injury, wrongful death and/or property damage.

The BMW defendants deny any wrongdoing but they agreed to settle the engine defect class action lawsuit to avoid the time, expense and uncertainty of ongoing litigation. The BMW settlement documents did not provide an estimated value for the deal. However, the plaintiffs’ attorneys say the class action settlement will provide Class Members with benefits that would equal or surpass the amount they could have received if the case had gone to trial.

Class Members of the proposed BMW settlement includes anyone in the United States who purchased or leased a model year 2009 through 2014 BMW 5 Series, 6 Series, 7 Series, X5 or X6 vehicle with an N63 engine.

Under the terms of the proposed BMW engine defect settlement, Class Members are entitled to a free battery and $75 per oil service for up to three future oil changes. They will also be provided with a voucher worth $1,000 to $1,500 off a new BMW vehicle.

Some drivers may be eligible for reimbursement for expenses related to the battery and oil consumption issues, if they are able to provide receipts or other documentation of the costs. Drivers who meet specific conditions may be able to recoup at least some of the expenses they faced to replace the vehicle engine after multiple repair attempts.

    My 2012 X5 50i consumes approximately 2 quarts of oil every 500 miles! This is unacceptable. I took my X5 to the local BMW dealreship and I was told that the fix would cost $13,293.27 or that I could replace the motor at a cost of $14,791.25. Please add me to this lawsuit.

    I purchased my 2012 x5 in may of 2017. Since then I have had my oil changed 8 times!!! One time I was in another state and had to learn how to do my own oil change just to get home. My sub could not go over 300 miles with out going through all of my oil. I video recorded and took pictures of it all. I complained that the fumes cause me to get naucious and burn. My eyes almost every time. You can smell it when it happens and feel the driving difference. I was so heartbroken, because I waited so long and worked so hard to get this car. I emailed BMW directly about it and have been on my dealership where the mechanic blew me off twice. He said it was norm to need an oil change that frequently due to my engine type. That was bull! Ever 200-300 miles are u kidding me. This is why TrueCar is the future for females. We are not dumb and this treatment to ignore something that affects a person with respiratory problems is disturbing. Maybe I should have gotten the Mercedes after all :(, but that’s not what I needed for my life style.

    My 2012 650i xdrive convertable with only 46000 miles has used over 3quarts since I bought it in Dec 2017!!! Now I know why prior owner sold I. Add me to the lawsuit. I work for a used car dealer in Dallas and was not informed of this problem. We have several of these cars in stock!!! PANIC!

    I purchased my 750LiXdrive from BMW Cleveland. I have been complaining for the beginning. I was told by BMW advisors, that’s normal. Really. I don’t think so. This vehicle is burning some much oil until I carry quarts of in my truck at all times. The proposed settlement is a joke. Two oil changes and a voucher. NO THANKS. How about you take this vehicle back and reimbursement for it. LEMON. Or replace the engine on this thing. Many people have these cars and cant trade them, too much negative equity. I have tried several times and just is unwilling to take that large hit. But know, maybe I should take the hit and give this LEMON back. BMW should be will to do more. In my opinion, the settlement does nothing for the consumer.

    I have a 2014 550xi. I have put 15k miles on the car and have added 20 pints of oil at the dealership where I purchased the car. No one, salesmen, never told me anything about the oil issue that has been going on for years. It’s now documented that the engine builder built a cheaper block which cause the oil issue. BMW US has already started to lower the engine replacement reimbursement by 75%. Being an executive billing over $500.00 per hour I want a new engine, new warranty and 3 hours @ $500.00 per hour times 10 visits to Auto Nation BMW for oil fill ups. This isn’t normal. Start posting on social media to dump BMW and buy a Mercedes, Lexus or etc. BMW’s settlement is a joke. It’s time to park our oil burners with huge signs around the dealerships. If the dealership informed me at the time of purchase of this problem, fraudulent misrepresentation, I never would have bought problem from BMW. I recently tried to trade my oil burning BMW for a Mercedes and they said if they wanted an oil burner they would buy a diesel and laughed and told me they didn’t want the trade. This car has cost me a ton of money and BMW offers free oil changes 3 times with a battery. This looking like VW diesel lies and Japan’s air bags. Wake up BMW because you clients have the money to kick your ass a will.

    I purchased a 2009 750 Li in April 2018. I’m already adding 1 qt. every 750 miles. ;-(

    I’ve serviced the transmission after it violently jerked when coming to a stop. Now I’m dreading future problems. This is my first BMW, and I’m really disappointed so far. It’s a beautiful car, but I’m likely going to sale it and move on to Mercedes.

    I purchased my 2012 BMW X6 50i a 1 1/5 years ago & have had this problem the majority of that time: excessive oil consumption & battery draining. Please include me on any class action suit available.
