A group of plaintiffs from across several states have joined the litigation against the makers of Actos as a group.
Actos is a drug designed to help treat type-2 diabetes. Type-2 diabetes is a chronic condition wherein patients cannot control the amount of glucose (sugar) in their blood. However, numerous postmarket reports, and epidemiological studies, have suggested that Actos can greatly increase the risk of developing bladder cancer. Additionally, research found a dose-dependent risk, that patients taking more Actos had a proportional increase in their risk of bladder cancer, further strengthening claims that Actos could cause bladder cancer.
Actos Bladder Cancer Lawsuits
Actos lawsuits allege that not only can Actos cause bladder cancer, but that the makers of Actos, Takeda Pharmaceuticals and related companies, were aware—or reasonably should have been aware—of the risk. To back this assertion, Actos lawsuits cite postmarket reports and epidemiological studies that suggest a risk of bladder cancer. In fact, the FDA has issued a black box warning for Actos, warning that taking the drug increases the risk of bladder cancer and that doctors and patients must consider the risk of this potential Actos side effect.
So many Actos bladder cancer lawsuits have been filed that the court system has resorted to a process called a multidistrict litigation or MDL to coordinate them. In MDLs, the court system groups together similar lawsuits, so earlier Actos lawsuit verdicts can influence later Actos lawsuits—possible leading to mass settlements if early Actos lawsuits go in favor of the plaintiffs.
In this current Actos lawsuit, four plaintiffs are joining the massive Actos MDL. This involves four plaintiffs from the states of Arizona, California, Tennessee, and North Carolina. Their Actos lawsuit makes the same allegations found in the bulk of other Actos lawsuits, that Actos can cause Actos bladder cancer, and that Takeda Pharmaceuticals did not do enough to protect the public from the risk of Actos bladder cancer.
The Actos Lawsuit is Case No. 0190, within the larger Actos MDL In Re: Actos (Pioglitazone) Products Liability Litigation, MDL No. 2299, in the U.S. District Court for the Western District of Louisiana.
