The City of Sacramento will pay $500,000 to end a class action lawsuit filed after police officers allegedly engaged in “kettling” to trap protesters in a May 4, 2019, Stephon Clark demonstration, according to recently filed court documents.

US Magistrate Allison Claire signed the final approval order in which the city has agreed to pay $496,800 which will be used to pay Class Member awards and medical expenses, along with $82,800 in legal fees on Wednesday.

In addition to a settlement award, Class Members will be able to take part in a $50,000 medical compensation fund. Those that can verify that they incurred extra medical expenses in the week after the protest can claim a share of the fund, says the final approval order.

Protesters filed the class action lawsuit against the City of Sacramento and its police department in the aftermath of alleged “kettling.” The plaintiffs claimed that police trapped demonstrators during a protest after the shooting of Stephon Clark, rounding them up on the 51st Street overpass and arresting 84 people en mass.

The class action lawsuit claimed that police officers, clad in riot gear, acted in retaliation and violated their right to protest. They claimed that they were arrested without cause or warrants and many required medical attention.

“The March 4, 2019, demonstration was the first to occur in a wealthier, predominantly-white area of Sacramento. Unlike prior demonstrations involving the death of Stephon Clark occurring in other locations within Sacramento, the March 4, 2019, demonstration was the first to involve a mass arrest response by law enforcement,” stated the class action lawsuit.

Four plaintiffs sought to represent more than 400 protesters who they say were harmed by Sacramento city police actions that day.

According to the final approval order, neither the City of Sacramento nor its police department admits any wrongdoing in the handling of Stephon Clark protesters during the March 4, 2019 demonstration.
