Bayer Corporation falsely advertises its One a Day Natural Fruit Bites multivitamin products as “natural” even though they contain synthetic ingredients, according to a class action lawsuit filed May 31 in New York federal court.
Plaintiff Deniece Drake says she purchased the women’s version of the One a Day Natural Fruit Bites multivitamins after reading the label indicating the product was “natural.”
Drake says she believes that products labeled as natural do not contain synthetic ingredients. Had she known that the Bayer One a Day Natural Fruit Bites multivitamins contain synthetic ingredients, she said she would not have been willing to pay as much for them.
Bayer class action says company charged premium for One a Day Natural Fruit Bites multivitamins
The Bayer class action lawsuit notes that consumers have grown increasingly concerned about the presence of synthetic ingredients in food, beauty products, and everyday household products. In response to the demand for products without synthetic ingredients, companies have increasingly offered products purported to be “natural,” which are often sold at a premium price.
“Reasonable consumers, including plaintiff and class members, value natural products for important reasons, including the belief that they are safer and healthier than alternative products that are not represented as natural,” the Bayer class action lawsuit states.
Drake says the One a Day Natural Fruit Bites labels are misleading because they contain synthetic ingredients, including cholecalciferol, niacinamide, pyridoxine hydrochloride, D-biotin, and potassium iodide.
She notes that consumers would not know the true nature of the ingredients by reading the label because the ingredients list does not disclose the manufacturing process for each ingredient.
“Discovering that the ingredients are not natural and are actually synthetic requires a scientific investigation and knowledge of chemistry beyond the everyday knowledge of the average consumer,” Drake explains.
Therefore, reasonable consumers cannot be expected to understand that the ingredients listed on the product label are synthetic, according to the Bayer class action lawsuit.
The One a Day Natural Fruit Bites class action lawsuit asserts claims for violations of New York General Business Law Sections 349 and 350.
Drake is not the first plaintiff to challenge the multivitamins’ “natural” claims. Last year, a man who purchased Bayer’s One a Day Natural Fruit Bites filed a Bayer class action lawsuit claiming the products were deceptively marketed as “natural” even though they allegedly contain synthetic ingredients.
