Molekule Air Purifier Class Action Lawsuit Overview:

Despite their sleek appearance and boasts of superiority, Molekule air purifiers are not as effective at purifying the air as the company claims, a new class action lawsuit alleges.
Plaintiff Barbara Sobel claims Molekule misleads consumers by falsely marketing and advertising its air purifiers as highly effective at removing air pollution and providing allergy and asthma relief.
Sobel wants to represent a New York Class of consumers who purchased a Molekule air purifier as well as a multi-state Class of consumers from Iowa and Arkansas.
The air purifiers named in the class action lawsuit are the Molekule Air, Air Pro, Air Mini, and Air Mini+. The purifiers use photo electrochemical oxidation (PECO) technology, as opposed to the more commonly-used high efficiency particulate air, according to the class action lawsuit.
Sobel alleges Molekule markets the products online and touts the effectiveness of using PECO technology to purify the air, claiming it rids the air of microbes, allergens, chemicals, and other forms of pollution.
“However, the Molekule products were found to be ineffective in purifying air by The Wirecutter, a popular consumer electronics review website,” states the class action lawsuit.
Molekule Advertising Claims Amount to Hot Air
In 2019, the National Advertising Division (NAD) of BBB National Programs found Molekule’s claims of quantified pollution removal, allergy and asthma relief, and superior PECO technology were “without support.”
Sobel alleges that while Molekule agreed to modify its claims based on the NAD’s findings, they still were misleading consumers.
“The pervasive nature of the claims ensured consumers would rely on false, deceptive, and misleading claims when seeking to purchase an air purifier,” states the class action lawsuit.
Molekule falsely claimed its air purifiers were able to “destroy” 100% of airborne pollutants, 1 million allergens in four minutes, 3.4 million black mold spores in 50 minutes, and 3.7 million bacteria in five minutes, among other things, according to the class action lawsuit.
Sobel claims Molekule’s testing was neither independent nor able to not provide enough evidence to show its air purifiers could eliminate all air pollutants.
Plaintiff alleges Molekule is guilty of negligent misrepresentation, fraud, and unjust enrichment, and is in violation of New York General Business Law and the Magnuson Moss Warranty Act.
Sobel is demanding a jury trial and requesting injunctive relief as well as monetary, statutory, and/or punitive damages for herself and all Class Members.
A similar class action lawsuit was filed earlier this summer against Global Plasma Solutions Inc. which alleged the company falsely claimed its air purifiers could cleanse the air of the COVID-19 virus.
