Global Plasma Solutions Air Purifier Class Action Lawsuit

Global Plasma Solutions Inc. (GPS) preys on people desperate to cleanse the air and protect themselves from ailments including the COVID-19 virus with its false and misleading statements about the abilities of its air purifiers, a class action lawsuit alleges.

The class action was filed in Delaware on May 7 by lead Plaintiff Robert Garner who alleges that the company makes false, deceptive, and misleading statements that were “mere puffery” about the needlepoint bipolar ionization technology used in its devices.

Despite representations that its Products clean the air – including eliminating the COVID-19 virus – Defendant’s products make the air worse for people because the products reduce some volatile organic compounds (VOCs) but actually increase the concentration of other VOCs,” the class action lawsuit states.

Garner says in the claim that adding to the company’s deception, it hides significant defects in its products and has deceptively represented company funded testing as “independent,” while also using test conditions that are not representative of the real-world use of the products.

“Defendant’s ‘profits over people’ scheme won the company acclaim, publicity, and generated hundreds of millions of dollars in sales at the expense of the Plaintiff and Class Members across the country,” the claim says.

It adds that GPS is instilling customers with a false sense of security through misleading claims by overstating its products’ COVID-19 mitigation performance.

According to the class action lawsuit, GPS used a chamber the size of a shoebox to support its claim that its air purifiers could kill COVID-19 for a home or school. It adds that in another instance, GPS “blasted” the testing chambers with 27,000 ions per cubic centimeter – far in excess of concentrations achievable in real world settings.

“When Defendant’s Products have been independently tested in real world conditions, they consistently fail to achieve the results as represented by Defendant.”

In February, professors at three major universities released an academic article that examined the effectiveness of one of GPS’s devices using bipolar ionization technology. The article concluded that “the device in our testing was ineffective in addressing the air pollutants that it’s advertised to remove from the space,” the claim states.

Boeing also conducted a study into the technology and found “minimal reductions in viral inactivation,” the class action lawsuit says.

“The test also found only ‘minimal reductions in surface bacteria viability by bipolar ionization.’ Further, the Huntsville test found ‘no reductions in Staphylococcus aureus, Pseudomonas aeruginosa, Enterococcus faecalis, and Enterobacter cloacae’.”

The Boeing study concluded that use of air ionization in an airplane remains inconclusive as a methodology against the SARS-CoV-2 virus.

The class action lawsuit states that GPS markets directly to consumers’ fears, and even takes “precious dollars away from effective means of virus mitigation” by accepting tax funds to purchase GPS air purifiers.

Garner wants to represent a nationwide Class, multistate Class, and Maryland subclass of consumers affected by GPS’s “fraudulent, deceptive, and misleading conduct.” He is suing for breach of implied and express warranties and unjust enrichment. He seeks Certification of the Class, damages, enjoinment, interest, legal fees, and a jury trial.

In November 2020, another manufacturer of air purifiers was hit with a class action lawsuit. The claim alleged that Molekule air purifiers are falsely advertised as able to clean the air of pollutants and viruses such as COVID-19.
