FanDuel False Information Class Action Lawsuit Overview:

U.S. District Judge Elaine Bucklo tossed a pending class action lawsuit against FanDuel, an online sports betting company, that alleged it provided bettors with inaccurate scores and game times, inducing wagers based on false information.

Plaintiff Andrew Melnick claims he and others were duped into thinking they were placing much more advantageous bets based on the false information provided by FanDuel on its sports betting app that purports to provide “real-time” information to bettors.

However, in his 12-count complaint, Melnick specifically cites user terms and conditions that state FanDuel “shall not be liable for any delay in relaying up-to-date information” delivered via its app, the judge wrote in her dismissal.

“Plaintiff’s reliance on this provision as the source of defendant’s putative obligation to provide ‘accurate real-time information’ is perplexing as the provision expressly disclaims the very obligation plaintiff reads into it,” she wrote. 

Melnick sought to represent users from Illinois and nine other states where FanDuel Sportsbook operates, claiming deceptive trade practices and violations of consumer protection laws in those states. 

Class Action Claimed FanDuel ‘Misled’ Bettors With False ‘Real Time’ Info

The plaintiff’s allegations stem from an “over/under” bet he made in February of this year on FanDuel concerning a men’s NCAA college basketball game. Melnick said he placed a bet based on the remaining game time information provided on FanDuel; however, he later found out that the game time information provided by the online betting company was off by up to 35 percent from the actual time.

Melnick said after he discovered the discrepancy in game time information provided by FanDuel’s app, he attempted to get a refund by calling customer service; however, he says his request was denied.

In the dismissed class action lawsuit, Melnick contends the false information is no mistake. Instead, he claims “while purporting to provide its customers with real-time, live sports game data, FanDuel regularly understates the time remaining in a given live sporting event in order to induce its customers to make wagers that they are more likely to lose, and/or that are riskier, than if they were being provided accurate, real-time information in connection with their live wagering,” the lawsuit states.

In addition to false info about game times, the dismissed class action lawsuit argued FanDuel provides inaccurate information about the score of the game. Class Members “have made and lost wagers that they would not have made had they known the actual time remaining in the given sporting event or, in the alternative, they would have, instead, wagered on the ‘Over’ and won that wager, rather than losing a wager placed on the ‘Under.’”

    Yes I was tricked for months I was like I know I want I know I want then my money would change and I’m like maybe I’m tripping and then last week or this week I was sitting there playing playing and then I’m watching and I’m like I’m not tripping so I got them on tape I’m not giving me my money or something cuz I got different tapes and I sent them the part whatever and I was saying I was just trying to make extra money to go to my son’s graduation and stuff and I said you cheated me just give me back by $1,200 I was like I don’t even know how much more that cuz I don’t have the proof that you took off of me each time cuz I wasn’t taping it or something like that and they replied whatever they sent me a $198 I don’t know what for cuz I have sports bets on there cuz they have gave me a $400 sportback when they had made me lose $400 but anyway I have different tapes and I cut them I had to cut the one in different parts cuz it was too long and then they said oh well maybe you need to take a break we suspended your account because your remarks about your son’s graduation I’m not a gamble-holic like that I wouldn’t spend money that I need and then they put prices and then I spent whatever first of all I’m not the only one that uses my account and it doesn’t matter what I spend it doesn’t matter that you cheated me and then I tried to get it today where they cheated me out of 128 dollars and I have it on recording but the part of you can’t see the money where to tell that they did you might can hear me talking but I have other recordings I don’t know what they show but I’m going to try to catch him again but I don’t know I done lost most of the money trying to catch them but that’s my fault but I just wanted them to quit cheating people and what else I can’t think but I mean there’s more much more to this but if you can call me back or let me know because it is so unfair and they’re making people lose thousands of dollars oh and like today I stayed on banger cuz I’m like they had to pick up they have to make banker win so they make money they made player when almost the whole shoe except every once and then don’t let me up like $30 and then they’ll take me down and they made me lose 300 before because they kept making player wins but I was making them lose too money because I was going to make banker win because I was on it and I mean there’s so many ways that if you pay attention you can tell that they switched I mean they have something that switches the car they can make whoever they want to win or make it a tie but I don’t know there’s a lot more could you please give me a call or something thank you

    There should be a class action lawsuit against FanDuel regarding how rigged their online casino is. I would love to see their online blackjack odds versus regular blackjack odds. Dealer hits 4-5 cards to beat a 20 and dealer always seems to start with a face card. It is deceptive, malicious, and a money steal.

    FanDuel also suspended my account after I had concerns about double deposits. They refused to let me back in. Now, I have no idea what happens to my balance or remaining bets for the NBA Finals and upcoming College Football Playoff season. FanDuel is stealing from people and it needs to stop.

    I can provide evidence to prove that Betfair gave false data in the market offer itself. This complaint isn’t about the ‘current score’ , ‘other data provided by third parties’ or game times.

    This happened to me as well! They claim the following. “When scores are displayed in running, every effort is made to ensure the accuracy of the score and game time; however, no liability is accepted for incorrect information displayed.”
