Nectar mattress overview: 

  • Who: A mattress and bedding customer is suing Nectar Brand.
  • Why: The plaintiff says the company falsely advertises sale prices that actually represent the full price.

Nectar Brand holds fake mattress sales with made up regular prices, made up discounts, and made-up expirations that are both deceptive and illegal, a new class action lawsuit alleges.

Plaintiff Amanda Snow filed the class action lawsuit against Nectar Brand LLC on Oct. 31 in a California federal court, alleging violations of state and federal laws. 

According to the lawsuit, Nectar makes, sells and markets mattresses, bedding and other sleep-related products and sells them online through its website, nectarsleep.com.

Nectar’s website prominently advertises sales on its website. These advertisements include purported regular prices, purported discounts and a countdown timer that purportedly shows when the sale ends, the lawsuit states.

However, “everything about these advertisements is false,” Snow alleges.

“Nectar’s products do not retail at the supposed regular prices it lists. In fact, Nectar has never once sold a single product at its supposed ‘regular’ price. The supposedly ‘discounted’ prices are the prices that Nectar always sells its products for.”

Plaintiff wouldn’t have bought Nectar mattress if she knew it wasn’t discounted, lawsuit alleges

Snow says she bought a Nectar mattress and bedding thinking the products were on sale. However, the prices were not sale prices, they were simply the full price, she alleges.

“If the products she purchased weren’t on sale, she would not have bought them and would have instead comparison shopped,” she says.

Snow is looking to represent a nationwide class of customers who bought a Nectar product advertised as having a discount applied to it, plus a Washington subclass.

She is suing for violations of Washington consumer laws, breach of contract, breach of warranty and negligent misrepresentation, and is seeking damages, fees, costs and a jury trial.

Other sleep products have been in the news this year.

In April, a number of heated blankets and mattresses were recalled nationwide due to potential fire hazards.

    I also was swayed to buy the mattress based on substantial (as advertised) discount within limited time period.
    Mattress is new and very comfortable, but premature sagging would be reason enough for me to return it for refund.

      Same! Thought I was getting some deal and only had a few hours left. Had I’d known I would have shopped around. Bought 2 full size mattresses off this fake scheme.

    I bought a Nectar mattress about 2 years ago thinking I was getting a sale price. However, that “sale” price is still listed and is the same as it was.

    I purchased this bed also thinking it was on sale . It wasn’t . 7 days later I have severe back pain from the bed. They refuse to let me return even though they claim 365 day guarantee and I paid for a 10 year guarantee. They state call them again in 30 days. If they refuse again in 30 days I will hire a lawyer .

    I thought I was getting a good deal, Black Friday sale, 30 percent off. The counter was about to expire so I purchased it. Sure enough the next day it’s got the same timer. A week later, same sale price, its been almost a month, same timer, same sale, same products. I’ve brought this up with Nectar customer service asking for answers. Silence. This is false advertising and should be dealt with. Purple Mattress is facing similar complaints. Its only a matter of time….

        Also the remote for bedframe broke 3 months after warranty run out and they will not even sale me a remote they want to sale me another bed frame at a discounted price which is the regular price.

          I am 6 months past the warranty and my remote also will not work. Had tried to reset to no avail.

    I purchased the mattress and bed frame. The frame broke after two days and tried to get a refund they are trying to find parts in a warehouse for the bedframe. They want to replace the frame not return it.

    Fell for this tried to return at the 30 day mark but they are dodging my return and due to there insane pricing for the pillows and blankets they claim to be expensive and give for free and now non refundable and must be payed for so i would end up getting like 200 for the whole thing.

    Just fell for this as well. Tried to call them to get a price correction as the price online had lowered within days of my purchase and I was denied

    Fell for the alleged Nectar sale price trap. Might not be a big deal if product withstands test of time. Isn’t this a similar claim as to that made of Harbor Freight Tools pricing model?
