Nectar mattress overview:

Nectar Brand holds fake mattress sales with made up regular prices, made up discounts, and made-up expirations that are both deceptive and illegal, a new class action lawsuit alleges.

Plaintiff Amanda Snow filed the class action lawsuit against Nectar Brand LLC on Oct. 31 in a California federal court, alleging violations of state and federal laws. 

According to the lawsuit, Nectar makes, sells and markets mattresses, bedding and other sleep-related products and sells them online through its website, nectarsleep.com.

Nectar’s website prominently advertises sales on its website. These advertisements include purported regular prices, purported discounts and a countdown timer that purportedly shows when the sale ends, the lawsuit states.

However, “everything about these advertisements is false,” Snow alleges.

“Nectar’s products do not retail at the supposed regular prices it lists. In fact, Nectar has never once sold a single product at its supposed ‘regular’ price. The supposedly ‘discounted’ prices are the prices that Nectar always sells its products for.”

Plaintiff wouldn’t have bought Nectar mattress if she knew it wasn’t discounted, lawsuit alleges

Snow says she bought a Nectar mattress and bedding thinking the products were on sale. However, the prices were not sale prices, they were simply the full price, she alleges.

“If the products she purchased weren’t on sale, she would not have bought them and would have instead comparison shopped,” she says.

Snow is looking to represent a nationwide class of customers who bought a Nectar product advertised as having a discount applied to it, plus a Washington subclass.

She is suing for violations of Washington consumer laws, breach of contract, breach of warranty and negligent misrepresentation, and is seeking damages, fees, costs and a jury trial.

Other sleep products have been in the news this year.

In April, a number of heated blankets and mattresses were recalled nationwide due to potential fire hazards.

    I pride myself on getting a good deal, no matter what I’m purchasing. Had I known that the “sale price” was a scam, the countdown timer was fake, and I was deliberately deceived in order to rush my decision , I would have never done business with them. Furthermore, by scamming me with a fake count down timer I was unable to make a properly informed decision , and ended up buying a mattress that’s full of fiberglass. I’m angry , distrustful of this mattress and the company selling them. I’m fearfully of the health implications and I want compensated for this scam .

    Bought a Nectar directly from their website. It took much longer to get than they quoted. I also purchased the ‘bundle’ (mattress, mattress cover, duvet & duvet cover, as well as a sheet set) in Jan ‘22. The top of the mattress has developed an air pocket that is apparent when suiting or laying on it. I’ve developed terrible congestion, coughing fits and asthma attacks. My husband started getting a rash. Just learned about the recall of the Queen mattress manufactured in Sept 2021. And that they contain fiberglass.

    Bought a Nectar and the first night I had a horrible sleep. Wanted to return it instantly after the Labor Day sale. But the return does not represent the sale price so I have to pay 15% of the FULL PRICE which isn’t even real. So illegal

    How do I fill out the paperwork to join for the false advertisement clean?
    Also, could you please direct me to the claim on the nectar fiberglass lawsuit because I would like to fill out a claim for that as well!
