Oral-B charcoal class action lawsuit overview:
- Who: Maurice Forbes filed a class action lawsuit against The Procter & Gamble Co.
- Why: Forbes claims Procter & Gamble falsely advertises the teeth-whitening capabilities of its Oral-B brand charcoal toothbrush products.
- Where: The class action lawsuit was filed in New York federal court.
The Procter & Gamble Co. falsely advertises that its Oral-B charcoal toothbrush products provide teeth-whitening benefits, a new class action lawsuit alleges.
Plaintiff Maurice Forbes claims charcoal toothbrush products like the ones sold under the Oral-B brand have been shown to “have no meaningful effect on teeth whitening.”
Forbes argues further that Oral-B allegedly falsely advertises that its charcoal toothbrush products can “naturally whiten teeth in as little as one week.”
“Charcoal Products do not in fact provide whitening benefits and certainly do not provide whitening benefits within one week of use,” the Oral-B class action states.
Consumers pay a ‘premium price’ for Oral-B charcoal products, class action says
Consumers who purchased the Oral-B charcoal toothbrush products paid a “premium price” for them after they were “taken in” by the company’s “false promise of whitening,” the lawsuit claims.
“As a direct and proximate result of Defendant’s false and misleading advertising claims and marketing practices, Plaintiff and members of the Class, as defined herein, purchased the Charcoal Products,” the Oral-B class action states.
Forbes claims Oral-B is guilty of unjust enrichment, breach of express warranty and breach of implied warranty of fitness for a particular purpose and in violation of New York General Business Law.
He demands a jury trial and requests declaratory and injunctive relief along with an award of compensatory and punitive damages for himself and all class members.
Forbes wants to represent a nationwide class and New York subclass of consumers who have purchased an Oral-B charcoal toothbrush product.
In other Oral-B news, in May, a federal judge in Illinois denied Procter & Gamble’s request to have a biometric privacy claim revolving around its Oral-B brand “smart toothbrush” moved out of the state.

10 thoughts onOral-B class action claims Procter & Gamble falsely advertises charcoal teeth-whitening products
I purchased Oral B charcoal toothbrushes from Costco in late 2022 and after about 5 months i noticed a huge loss in my tooth enamel. My teeth are now partially transparent due to the enamel loss. Charcoal dental products are highly abrasive and should be removed from the market! I now have to look into veneers for my once beautifully white and strong teeth.
