Electrolux refrigerator defect class action lawsuit overview: 

  • Who: David Stern filed a class action lawsuit against Electrolux Home Products Inc. 
  • Why: Stern claims Electrolux knowingly sells refrigerators containing defective drawers and shelves he says are flimsy and prone to breaking within months of purchase. 
  • Where: The class action lawsuit was filed in New York federal court. 

Electrolux Home Products sells refrigerators built with drawers and shelves that “repeatedly break and fall apart within months after purchase,” a new class action lawsuit alleges. 

Plaintiff David Stern claims Electrolux “knew or was reckless in not knowing” that the refrigerators contained the allegedly defective shelves and drawers prior to the first unit being sold. 

“Notwithstanding this knowledge, Electrolux made uniform and material misrepresentations and uniformly concealed material information in its marketing, advertising and sale of the Refrigerators,” the Electrolux class action states. 

Stern argues that, instead of attempting to fix the refrigerator defect, Electrolux simply continued manufacturing refrigerators with defective drawers and shelves. 

“Electrolux did not implement a plan to address the defect and instead manufactured and sold subsequent models that contained the same defect,” the lawsuit states. 

Electrolux class action accuses company of negligence over alleged refrigerator defect

The refrigerator defect causes damaged and unusable food due to the “repeated breakage of the flimsy shelving and drawers,” resulting in the waste of otherwise “fresh and unblemished produce,” the Electrolux class action alleges. 

“Because of the Defect, the Refrigerators are deficient; do not meet advertised standards and fail of their essential purpose,” according to the lawsuit. 

Stern claims Electrolux is guilty of negligent misrepresentation and unjust enrichment, among other things, and in violation of New York General Business Law

Plaintiff demands a jury trial and requests injunctive and declaratory relief along with actual, treble and/or statutory damages for himself and all class members.

Stern wants to represent a nationwide class and New York subclass of consumers who own or have owned an Electrolux refrigerator containing allegedly defective drawers and shelves. 

Electrolux recalled certain Elecrolux and Frigidaire refrigerators earlier this month over concerns their ice level detector arms could break into pieces and become a choking hazard by falling into the ice bucket.

    We bought FGRU19F6Q and FGFU19F6QF for the new home we built in 2019, planning for 10+years of use. Our custom kitchen cabinet design incorporates this model with a 66″w opening, 79″ tall, and 27″ deep built-in. It looks superb. The shelf plastics started falling apart immediately (drawer fronts and door plastics). I’ve mended them several times using screws, rivets, and glue. The Fridge started freezing items on the top shelf. Now Fridge doesn’t keep cold at all. We had a technician out to seal the system and refill it at the cost of $600, but it only functioned for another month until the r134 leaked out into the atmosphere again. The Electrolux warranty is reduced to one year on this model. Other Frigidaire models include 2-5 year coverage for sealed system parts, with some at ten years. There are hundreds if not thousands of reports of this model having this defect published on the internet by way of consumer published reviews. I believe the manufacturer could release a repair bulletin and help us because it is so common. Instead, Frigidaire/Electrolux discontinued this model recently in 2022. We must replace Fridge, Freezer, and trim kit as no such model of the same size is available. A professional model is available but does not match the freezer and trim and requires a different opening of 2″ wider (impossible for us). Our kitchen is custom-built around this appliance set that only lasted 2.5 years. Frigidaire advertises they are ten-year warranty on the sealed system like other competing manufacturers. Still, when you read the fine print in their manual, many models are 2-5 years or limited to 1 year only (like ours). Please include us as we are out $4000 for the cost of the Fridge plus fees for changing kitchen cabinets to suit different size Fridge/Freezer/Trim. To other consumers, always check the last page of the manual and read the warranty fine print before you buy. To Lawyers, these products (fridges/freezers) have strict environmental restrictions on recovery and disposal of these fridge units due to the refrigerant charge used in the sealed system and the damage they cause to our environment. They should be designed and built of high enough quality, never to leak. These poorly built, defective design fridges are leaking! Our governments / EPA (Can/USA) impose stiff penalties for improper disposal of these appliances due to the risk of harmful gas escaping, yet we (society) allow these companies to operate without consequence, selling inferior systems which leak with repair liability limited to 1 year. Fridges used to be built to last 30 years, and now they are failing at 2 years. The gases from these failed units are escaping into the atmosphere causing environmental damage. USA/Canada needs to impose minimum standards on the warranty of these appliances, especially since they are causing harm to the environment. I’ve read that technicians who purposely vent R134 are subject to fines and criminal prosecution of tens of thousands of dollars per day. Why are the manufacturers not accountable for their inferior product’s release of these gases when the technicians and consumers are? I suspect Frigidaire’s (and other manufacturers’) design flaws are responsible for more 134 gas escaping into the environment than anyone is aware of, nor can we even imagine. Not to mention the waste of shipping and disposal resources for appliances than don’t last more than a few years.

    I OWN TWO FRIGIDAIRE PROFESSIONAL REFRIGERATORS; A SS SIDE BY SIDE UNIT, AND A SS FRENCH DOOR UNIT. BOTH HAVE HAD ISSUES BUT THE SIDE BY SIDE UNIT HAS NOT MADE ICE SINCE I PURCHASED IT. A TECHNICIAN CAME OUT TO INSPECT AND GOT THE UNIT TO WORK BUT IT ONLY WORKED FOR ABOUT 1 MONTH. THE SHELVES ARE FLIMSY AND ARE FALLING APART.
    JUST AS WELL THE MATCHING MICROWAVE OVENS HAVE A MANUFACTURERS DEFECT THAT SEVERED THE WIRING HARNESS LEADING INTO THE CONTROL PANEL. BOTH OF MY MICROWAVES ARE NOT WORKING AND ARE PRACTICALLY NEW.
    I REALLY NEED RELIEF AND WOULD LOVE TO HAVE ALL MY APPLIANCES WORKING AS THEY SHOULD.

      I own a fridgidaire refrigerator & the doors are junk. If you put 5 things in the door shelves the next time you open either door the retainer bar pops off & there goes your foot getting hit.

    Yes add me – my Electrolux Refrigerator purchased in 2021 leaked out the back corner (from inside the unit) and caused $71k in damage to my floors and walls. Insurance settled that and in the mean time was not able to collect from Electrolux so I didn’t get my $5k deductible refunded. A few months ago my same fridge broke a piece of the bottom icemaker off and into the ice. Two visits and the tech replaced the ice maker, the next day or two it stopped working again and I believe the water that is supposed to pump into it instead pumped into the ceiling of the bottom freezer and warped it so the now the middle drawer is warped and won’t close with out a big push/noise/clunk.

    Electrolux finally said they’d replace the fridge, I waited a couple of months, it arrived with 1 day notice last week with a huge dent in the back of it and another huge dent in the side of it. I did not accept it.

    Basically my existing refrigerator is a piece of junk.

    Please add me. in June, 2018 we purchased a Frigidaire Model #FFTR1821TWO refrigerator and within weeks, the cooler drawer support(s) broke away requiring the entire shelf to be replaced (it has since broken again and we no longer have use of it). Further, each of the five (5) Door Shelf Retainer Bars and cracked and broken at a replacement cost of approx. $45 each. We should have gone with a Whirlpool !

    Please add me. I have had countless issues with my Frigidaire refrigerator by Electrolux since purchasing 3 years ago. Leaking damaged kitchen floor as I waited 20+ days just to get their technician to come to my home and although technician stated faulty valve, company said No, valve was not faulty when I shipped it to them as requested. I have replaced broken shelves at least twice now, they crack or just break completely. I would like my name added to this class action. Thank you.

    All but one of our shelves are broken, both on the door and crispers. They injured my wife when they broke and pinched her hands causing blood blisters. There should have at least been a recall before little kids get hurt.
