Electrolux refrigerator defect class action lawsuit overview: 

  • Who: David Stern filed a class action lawsuit against Electrolux Home Products Inc. 
  • Why: Stern claims Electrolux knowingly sells refrigerators containing defective drawers and shelves he says are flimsy and prone to breaking within months of purchase. 
  • Where: The class action lawsuit was filed in New York federal court. 

Electrolux Home Products sells refrigerators built with drawers and shelves that “repeatedly break and fall apart within months after purchase,” a new class action lawsuit alleges. 

Plaintiff David Stern claims Electrolux “knew or was reckless in not knowing” that the refrigerators contained the allegedly defective shelves and drawers prior to the first unit being sold. 

“Notwithstanding this knowledge, Electrolux made uniform and material misrepresentations and uniformly concealed material information in its marketing, advertising and sale of the Refrigerators,” the Electrolux class action states. 

Stern argues that, instead of attempting to fix the refrigerator defect, Electrolux simply continued manufacturing refrigerators with defective drawers and shelves. 

“Electrolux did not implement a plan to address the defect and instead manufactured and sold subsequent models that contained the same defect,” the lawsuit states. 

Electrolux class action accuses company of negligence over alleged refrigerator defect

The refrigerator defect causes damaged and unusable food due to the “repeated breakage of the flimsy shelving and drawers,” resulting in the waste of otherwise “fresh and unblemished produce,” the Electrolux class action alleges. 

“Because of the Defect, the Refrigerators are deficient; do not meet advertised standards and fail of their essential purpose,” according to the lawsuit. 

Stern claims Electrolux is guilty of negligent misrepresentation and unjust enrichment, among other things, and in violation of New York General Business Law

Plaintiff demands a jury trial and requests injunctive and declaratory relief along with actual, treble and/or statutory damages for himself and all class members.

Stern wants to represent a nationwide class and New York subclass of consumers who own or have owned an Electrolux refrigerator containing allegedly defective drawers and shelves. 

Electrolux recalled certain Elecrolux and Frigidaire refrigerators earlier this month over concerns their ice level detector arms could break into pieces and become a choking hazard by falling into the ice bucket.

    My children purchased a Frigidaire brand side by side refrigerator for me on Christmas 2 years ago and since then I have replaced 4 shelves, two on the freezer side and two (2) on the refrig side. Also, the deli drawer plastic seal that encases the glass top of it broke right down and the plastic bin i terribly cracked down the middle causing spoilage of meats and cheeses. What is worse is I can’t find a replace for the deli drawer. Parts are listed as Electrolux and do not match the Frigidaire model. Truly an awful piece of kitchen equipment!

    yes I’ve have two and the shelves and drawers have snapped apart plastic has no flex it simply breaks cause it is very brittle

    Just bought a replacement fridge 6 months ago and within 3 months the lower shelf broke. Completely agree the flimsy design. Not only did the shelf break but I have cracking along the sidewall of our side-by-side fridge. This happened to our old one as well and the fridge never stayed as cool as it should’ve. There are other major flaws with their fridges besides the drawers and shelves though
