Electrolux refrigerator defect class action lawsuit overview: 

  • Who: David Stern filed a class action lawsuit against Electrolux Home Products Inc. 
  • Why: Stern claims Electrolux knowingly sells refrigerators containing defective drawers and shelves he says are flimsy and prone to breaking within months of purchase. 
  • Where: The class action lawsuit was filed in New York federal court. 

Electrolux Home Products sells refrigerators built with drawers and shelves that “repeatedly break and fall apart within months after purchase,” a new class action lawsuit alleges. 

Plaintiff David Stern claims Electrolux “knew or was reckless in not knowing” that the refrigerators contained the allegedly defective shelves and drawers prior to the first unit being sold. 

“Notwithstanding this knowledge, Electrolux made uniform and material misrepresentations and uniformly concealed material information in its marketing, advertising and sale of the Refrigerators,” the Electrolux class action states. 

Stern argues that, instead of attempting to fix the refrigerator defect, Electrolux simply continued manufacturing refrigerators with defective drawers and shelves. 

“Electrolux did not implement a plan to address the defect and instead manufactured and sold subsequent models that contained the same defect,” the lawsuit states. 

Electrolux class action accuses company of negligence over alleged refrigerator defect

The refrigerator defect causes damaged and unusable food due to the “repeated breakage of the flimsy shelving and drawers,” resulting in the waste of otherwise “fresh and unblemished produce,” the Electrolux class action alleges. 

“Because of the Defect, the Refrigerators are deficient; do not meet advertised standards and fail of their essential purpose,” according to the lawsuit. 

Stern claims Electrolux is guilty of negligent misrepresentation and unjust enrichment, among other things, and in violation of New York General Business Law

Plaintiff demands a jury trial and requests injunctive and declaratory relief along with actual, treble and/or statutory damages for himself and all class members.

Stern wants to represent a nationwide class and New York subclass of consumers who own or have owned an Electrolux refrigerator containing allegedly defective drawers and shelves. 

Electrolux recalled certain Elecrolux and Frigidaire refrigerators earlier this month over concerns their ice level detector arms could break into pieces and become a choking hazard by falling into the ice bucket.

    My Frigidaire is not even four years old. Both drawers are cracked and have been repaired numerous times, only to crack and leak again. I have had shelves collapse inexplicably during the night at least twice. Temperature control is very uneven — sometimes it warms up and sometimes it freezes.

    I live in California and would be HAPPY to be a lead in this Complaint. This product is hopeless.

    I have a stainless steel Frigidaire side by side refrigerator. The shelves have snapped out of the door. I also have the matching Frigidaire stainless steel stove. Last week the while everyone was asleep. Around 3 am the putter glass of the oven door. Something needs to be done about Electrolux !

    I live in a furnished apartment. The housing manager just replaced the Kenmore side by side refrigerator/freezer with a Frigidaire. Day One, the Frigidaire has been a disaster. The shelves in the freezer kept falling down as though gravity and the kitchen floor were its friend. Eventually, one broke. So, I try not use them often. And, the glass shelves inside the refrigerator are just as horrendous. The glass topper on the shelves does not flat because it’s either warped or the shelving is misaligned. By some miracle, the door shelves actually work, but they’re not made with a sturdy enough plastic for the job. Mine have cracks from fatigue after more than 6 months of usage. Had the Kenmore for more than 10+ years and never had these problems. If I had purchased this unit, I would’ve been one of the originators of the law suit. Electrolux and Frigidaire should be ashamed of themselves for the production and distribution of such products of subpar quality to consumers. This is NOT right!!

    This product sucks
    Not only do the drawers and shelves break and have clips that make the drawers nearly impossible to remove but this fridge ruins all produce I put into it after a couple of days
    It is constantly repeatedly freezing and thawing everything in the vegetable drawer and turning it to rotten mush and ruining it within days
    Probably has ruined thousands and thousands of dollars worth of vegetables
    I have tried every setting if I lower it the dairy goes bad within days
    If I raise it it ruins all the produce
    Also not the first problem I have had with this POS either , it was constantly freezing the water filter for the ice maker which is poorly places at the rear top of the refrigerator compartment
    It freezes it and then it bursts and floods my kitchen , there is water inside the fridge and all over the floor
    This has happened SEVERAL times caused me to have to buy new expensive water filters and also causing water damage to my rental apartment below
    Also there is no way to find suitable replacement air filters ,nobody sells them and the ones ones they do sell are designed all wrong and do not wort at all ,the original filter allowed air from a vent to pass through it ,the new ones allow no such thing and now I have odors with no way to get a proper replacement filter. Very poorly designed product at a premium price
