Walmart misrepresents that its Great Value brand Honey Mustard is primarily sweetened with honey, a new class action lawsuit claims.
Plaintiff Missy Baker claims that, despite Walmart labeling its Great Value Honey Mustard with pictures of dripping honey and the text “Made with Real Honey,” the product is, in fact, primarily sweetened with sugar.
Honey, in reality, is listed sixth as a sweetener on the product’s ingredients list, behind both sugar and salt, according to the Walmart class action.
Baker argues further that honey is not even a “significant sweetening ingredient” of Great Value Honey Mustard due to the product allegedly containing less than 64 mg of honey by weight.
“Consumers expect a product identified as honey mustard claiming to be ‘Made With Real Honey’ with pictures of a honey dipper and mustard seeds to be sweetened mainly with honey or at a minimum, contain honey as a significant sweetening ingredient,” states the Walmart class action.
Baker wants to represent an Illinois Class and multi-state consumer fraud Class of consumers who have purchased Walmart’s Great Value brand Honey Mustard during the statute of limitations.
Walmart’s alleged misrepresentations about the use of honey in its Great Value Honey Mustard allowed them to sell more of the product and at a higher price than they otherwise would have, the Walmart class action alleges.
“Plaintiff paid more for the Product based on the representations, and had she known the truth, she would not have bought it or would have paid less,” states the Walmart class action.
Baker claims Walmart is guilty of unjust enrichment, fraud, and negligent misrepresentation, and in violation of the Magnuson Moss Warranty Act, the Illinois Consumer Fraud and Deceptive Business Practices Act, and several state consumer fraud acts.
Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of monetary, statutory, and/or punitive damages for herself and all Class Members.
A separate class action lawsuit was filed against Walmart last month over claims the company falsely markets its Great Value brand Chocolate Caramel Coffee Creamer as a creamer since it allegedly does not contain enough milk to be considered one.
