The Quaker Oats Co. is facing a class action lawsuit in Illinois federal court claiming the company did not take the necessary steps to ensure its product was safe after a salmonella-related recall.

The company recalled some of its granola bars and granola cereals in December over concerns they are potentially contaminated with salmonella. 

The lawsuit accuses the company of negligent failure leading to the recall.

Quaker knew that there was a potential contamination from salmonella but did not inform consumers until the recall, the class action lawsuit says.

“Despite the known risks of salmonella, defendant has recklessly and/or knowingly sold the recalled products without disclosing the possible contamination,” the Quaker Oats class action lawsuit says. “Additionally, defendant knew or should have known that possible consumers would ingest the recalled products daily, often multiple times per day, thus compounding the possible exposures to salmonella.”

Quaker Oats customers had no reason to believe products unsafe, lawsuit says

A nationwide class and a South Carolina subclass, where lead plaintiff Teresa Herendeen lives, are proposed for the class action.

Consumers had no reason to believe the recalled granola bars or cereal were harmful, the class action says.

“Defendant’s omissions are material, false, misleading, and reasonably likely to deceive the public,” the class action says. “This is especially true, considering the long-standing campaign that markets the recalled products as healthy and high quality, as to induce customers to purchase the products.”

The class is asking for injunctive relief, damages, restitution and attorneys’ fees.
