Perfect Bar Protein Class Action Lawsuit Overview:

Perfect Bar misleads consumers about the amount of protein per serving its products contain, a new class action lawsuit alleges.
Plaintiffs Mehva Roffman and Lisa Chong claim Perfect Bar falsely advertises that its Perfect Bar in Dark Chocolate Chip Peanut Butter flavor contains “15G PROTEIN” and that its Perfect Peanut Butter Cups Dark Chocolate flavor contains “7G PROTEIN.”
“Consumers, in turn, reasonably expect that each product will actually provide the amount of protein per serving claimed on the front of the product package in a form that can be used by the body as protein,” the Perfect Bar class action states.
Roffman and Chong argue Perfect Bar’s protein labeling is misleading since it is only in the form of a “quantitative amount appearing alone without any information about protein quality.”
The U.S. Food and Drug Administration regulations prohibit a manufacturer from stating “the amount or percentage of a nutrient” on the front label if it is “false or misleading in any respect,” the Perfect Bar class action states.
Perfect Bar Class Action Claims Company Uses Nuts As Main Source Of Protein
Roffman and Chong argue the main source of protein in the bars is low quality since it comes from nuts such as peanuts, cashews and almonds, which have protein a human can only use 40 to 50% of.
“Accordingly, although Defendant advertises its Perfect Bar in Dark Chocolate Chip Peanut Butter flavor, for example, with a ‘15g PROTEIN’ claim, it actually provides, in a form that humans can use, as little as 7.5 grams of protein,” the Perfect Bar class action states.
Roffman and Chong claim Perfect Bar is guilty of unjust enrichment, among other things, and in violation of California’s Consumers Legal Remedies Act, False Advertising Law and Unfair Competition Law.
Roffman and Chong want to represent a nationwide class and California subclass of consumers who purchased the Perfect Bar products since Apr. 22, 2018.
Plaintiffs are demanding a jury trial and requesting compensatory, statutory, punitive and treble damages for themselves and all class members.
A separate class action lawsuit was filed against Perfect Bar in 2018 over claims its bars are falsely advertised as a health food due to the amount of sugar they contain.
