Perdue, Tyson Chicken Price-Fixing Class Action Settlements Overview:

  • Who: Perdue and Tyson have received final approval for $35 million worth of settlements with chicken farmers.
  • Why: The settlements end claims the poultry retailers colluded to raise the price of chicken.
  • Where: The settlements were approved in Oklahoma federal court.

A judge has given final approval to $35 million worth of settlements between chicken farmers and companies Perdue and Tyson after the pair were accused of colluding with other co-conspirators to hike the price of chicken.

In an order filed Feb. 18, Oklahoma federal Judge Robert J. Shelby gave his final approval for settlements for both the companies in this case. 

This is one of many lawsuits filed against Perdue, Tyson Foods and other big poultry producers alleging the companies of colluding to control the price and supply of chickens bred for consumption.

The plaintiffs in this case include Haff Poultry, Inc., Nancy Butler, Johnny Upchurch, Jonathan Walters, Myles Weaver, Melissa Weaver, Marc McEntire, Karen McEntire, Mitchell Mason, Anna Mason, Barry Mason, Jonathan Tipton and Henry Randall Colvin. 

The plaintiffs filed their first complaint in the lawsuit more than four years ago on Jan. 27, 2017. 

They alleged that Tyson, Perdue and more than a dozen co-conspirators engaged in an overarching conspiracy to suppress compensation paid to broiler chicken farmers nationwide in violation of the Sherman Act and the Packers and Stockyards Act.

Settlements End Allegations That Perdue, Tyson Fixed Chicken Prices

Under the settlements, Perdue will pay $14.75 million and Tyson will pay $21 million to end allegations the pair worked together and with others to violate federal antitrust law by fixing the price of chicken, harming the farmers who grow them. 

The claims alleged that the companies used third-party data compiler Agri Stats to set compensation levels for chicken farmers, known as “chicken growers” in the industry, and control everything from the prices they paid for the chickens to certain specifications of the facilities where the farmers work.

Many of the chicken farmers class action lawsuits were consolidated, but others have continued to be litigated on their own, netting millions of dollars in settlements. 

Last year, Tyson Foods agreed to a $221 million settlement to get out of a lawsuit claiming it had participated in a scheme to increase the price of chicken, and last month, the company agreed to another settlement for $1.75 million to end similar claims about turkey prices.

Pork and turkey meat processing industries have also been swept up in allegations of price-fixing. 

Currently, 15 of the pork cases are consolidated in multidistrict litigation in Minnesota with the U.S. Judicial Panel on Multidistrict Litigation adding the last two suits to the fold last June.

    So hauled a load for Tyson chicken back in November the broker refused to pay us living night mare literally so clearly they are still doing this

    I always bought Tyson chicken until three years ago when I discovered they had been sending their chickens to china to be processed. So, I started buying the ‘more expensive’ Perdue because they were to be American raised and processed. I have chicken twice a month for my family. And anyone who has been to the grocery store in the last three years, suddenly realizes, you try you best to get good prices because everything is outrageously priced. It is, without a doubt, intentional price hikes to destroy the middle and lower class. And they’ve done a really good job of that. Now to discover these companies been ripping us off too? Kind of like $5.00 a dozen for eggs?? The consumer in this country doesn’t stand a chance of ‘just surviving’!
