Country Crock avocado oil class action overview:

A vegetable oil consumer is suing the maker of Country Crock plant butter, Upfield US, alleging the company misleads consumers about the amount of avocado oil in its spreads.

Casanova Redmond filed the class action lawsuit against Upfield US Inc Nov. 14 in an Illinois federal court, alleging violations of state and federal consumer law. 

According to the lawsuit, Upfield manufactures and sells vegetable oil spreads made with alternative vegetable oils that state “Made With Avocado Oil” with a picture of an avocado and avocado pit under its Country Crock Plant Butter brand.

However, even though the product claims to be “Made With Avocado Oil” with a picture of an avocado and green packaging, it contains a minimal amount of avocado oil, the lawsuit states.

“The ingredient list shows avocado oil is the smallest part of the vegetable oil blend, less than palm fruit oil, palm kernel oil and canola oil,” the Country Crock class action says.

Upfield misleads customers with avocado representations, Country Crock class action alleges

Consumers expect “Made With Avocado Oil” with a picture of an avocado to mean the product contains more than a relatively de minimis amount of the valued avocado ingredient, the lawsuit states.

“The amount of avocado oil is insufficient to confer health it is known for,” the Country Crock avocado oil lawsuit says.

“As a result of the false and misleading representations and omissions, the Product is

sold for a price premium, approximately no less than $4.89 per 16 oz., excluding tax and sales, higher than similar products, represented in a non-misleading way, and higher than it would be sold for absent the misleading representations and omissions,” according to the class action. 

Redmond looks to represent an Illinois class of consumers who bought the product, plus a consumer fraud multistate class of consumers from Arkansas, Iowa, Wyoming, Texas, Nebraska, West Virginia, Utah, Idaho, Alaska, Virginia and Oklahoma.

Redmond sued under state consumer fraud acts and for breach of warranty, negligent misrepresentation and fraud. He seeks damages, disgorgement of profits, fees, costs and a court judgment. 

In related news, a consumer hit Upfield US Inc. with a class action lawsuit alleging it falsely advertises its Country Crock Plant Butter vegetable oil spread as having more almond oil than it actually does.
