A proposed $5.5 million settlement has been reached in a series of class action lawsuits that claimed Smashburger falsely advertises the amount of beef in its Triple Double burgers.

Class Members will be able to claim up to $20 without providing proof of purchase.

In one of the class action lawsuits, lead plaintiff Andre Galvan claimed Smashburger’s Triple Double varieties of sandwiches were advertised as containing “Double the Beef” of the regular burgers.

However, the burgers allegedly contain half-size beef patties, and therefore contain the same amount of beef used in the regular-size varieties.

French Onion Triple Double hamburgers or Pub Triple Double hamburgers between July 1, 2017, and May 31, 2019.

Under the terms of the settlement, Class Members will be able to recover various forms of relief.

Class Members will be eligible for a cash refund of $4 for each product purchased, up to a maximum of five, for a total of $20.

In addition to the settlement fund, Smashburger will provide 1.5 million vouchers, each valued between $2 and $2.49. The vouchers will provide at least an additional $3 million.

Rather than cash, Class Members may choose to receive up to 10 of these vouchers, for a total value between $20 and $24.90. 

The vouchers will be transferable and will entitle the holder, with the purchase of a regularly priced entree at a company-owned Smashburger, to upgrade a single-beef burger to a double-beef burger or get a small fountain drink at no additional cost.

Smashburger owns about 120 restaurants across 20 states.

If the Class requests fewer than the 1.5 million vouchers, Smashburger will donate the remaining vouchers to Boys and Girls Club, subject to approval by the Court.
