Tag Power Stick Benzene Contamination Class Action Lawsuits Overview: 

  • Who: Rachid Kallamni and Marvin Isaac Fuentes Rodriguez filed separate class action lawsuits against MY Imports USA LLC and A.P. Deauville, LLC, respectively. 
  • Why: Kallamni and Rodriguez claim the Tag and Power Stick brand body spray products they purchased were found to be contaminated with benzene, a known human carcinogen.
  • Where: The class action lawsuits were filed in New York federal courts.

Tag brand body sprays and Power Stick body sprays contaminated with benzene, a known human carcinogen, were sold by MY Imports USA LLC and AP Deauville, LLC, two separate new class action lawsuits allege. 

Plaintiff Rachid Kallamni claims MY Imports failed to disclose to consumers that certain of its Tag brand body sprays were contaminated with benzene, despite listing its other active and inactive ingredients. 

“Consumers expect the ingredient listing on the packaging and labels to accurately disclose the ingredients within the Products,” states the class action lawsuit. 

Kallamni argues that disclosing benzene is imperative since it is a known human carcinogen that can lead to certain blood cancers such as leukemia. 

Despite this, Kallamni claims MY Imports specifically advertises the Tag brand body sprays as safe to use while marketing it specifically towards “health-conscious consumers.” 

“However, Defendant’s advertising and marketing campaign is false, deceptive, and misleading because the Products contain benzene, which Defendant does not list or mention anywhere on the Products’ packaging or labeling,” states the class action lawsuit. 

Kallamni wants to represent a nationwide class and New York subclass of consumers who purchased Tag brand body sprays that were found to be contaminated with benzene. 

Plaintiff Marvin Isaac Fuentes Rodriguez, meanwhile, claims AP Deauville misleads consumers about the contents of certain of its Power Stick body sprays by failing to disclose they are contaminated with benzene. 

Rodriguez claims consumers relied on the company’s representations when purchasing the Power Stick body sprays, who he argues have “no value” since they contain traces of benzene. 

“A body spray product that contains benzene are in no way safe for humans and are entirely worthless,” states the class action lawsuit. 

Rodriguez wants to represent a nationwide Class and New York subclass of consumers who purchased Power Stick body sprays found to contain benzene. 

Tag, Power Stick, Others Named in Benzene Contamination Study, Class Actions

The benzene contamination was brought to light following a study conducted by Valisure, an independent analytical pharmacy, which discovered a number of skincare and cosmetic products contained traces of benzene. 

Valisure would go on to file a citizens petition in May, urging the Food and Drug Administration to pull the products that were found to be contaminated with benzene off store shelves. 

Kallamni and Rodriguez separately claim MY Imports and AP Deauville are in violation of New York General Business Law. They are both demanding a jury trial and requesting relief in the form of monetary, statutory, punitive, and treble damages for themselves and all Class Members. 

The class action lawsuits join a number of complaints filed in the wake of the Valisure study, including against the manufacturers of Banana Boat sunscreen, Old Spice antiperspirant, and Suave antiperspirant spray, among others.

The Tag, Power Stick Benzene Contamination Class Action Lawsuits are Rodriguez v. A.P. Deauville, LLC, Case No. 1:21-cv-06713, in the U.S. District Court for the Eastern District of New York; and Kallamni v. MY Imports USA LLC, Case No. 1:21-cv-10261, in the U.S. District Court for the Southern District of New York.
