A new class action lawsuit accuses Amazon of selling children’s sunscreen products with undisclosed levels of heavy metals, such as cadmium and lead.
Plaintiffs Lauren Wolf and Elizabeth Correia filed the class action complaint against Amazon.com on April 30 in Washington federal court, alleging violations of state and federal consumer laws.
According to the class action lawsuit, Amazon sells children’s sunscreen products with alarmingly high levels of heavy metals, including cadmium and lead, without warning consumers.
The lawsuit claims that recent testing of sunscreen products sold by Amazon revealed the presence of heavy metals, which can pose significant health risks, especially to infants and children.
Wolf and Correia claim Amazon is responsible for the content of the product listings that describe the sunscreen products to consumers. The company allegedly establishes requirements for manufacturers’ product descriptions and inserts its own descriptions via an artificial intelligence technology called “Rufus.”
The lawsuit alleges Amazon’s product listings do not disclose the presence of heavy metals in the sunscreen products.
The plaintiffs argue that reasonable consumers would want to know about the presence of toxins in any product, especially one that is applied directly to the skin of infants and children.
Amazon allegedly engaged in deceptive business practice
The class action lawsuit claims Amazon’s failure to disclose the presence of heavy metals in the sunscreen products is a deceptive business practice.
The plaintiffs allege that no reasonable consumer would expect the children’s sunscreen products to contain heavy metals based on Amazon’s point-of-sale disclosures.
They argue that Amazon’s business practices were deceptive, misleading, unfair and/or false because the sunscreen products contained undisclosed toxic heavy metals.
The class action lawsuit seeks injunctive and monetary relief on behalf of a proposed class of consumers who purchased the sunscreen products from Amazon for personal or household use.
The plaintiffs are seeking an order requiring Amazon to fully disclose the presence of heavy metals in its marketing, advertising and labeling of sunscreen products, as well as to test all sunscreen products for heavy metals.
Meanwhile, a group of Oregon residents filed a class action lawsuit against Amazon Data Services, alleging it contaminated drinking water in two counties by discharging industrial wastewater that contributed to dangerously high nitrate levels in Morrow and Umatilla counties.
