Banana Boat Sunscreen Benzene Class Action Lawsuit Overview:

  • Who: Luis Chabla and Jessica Barton filed a class action lawsuit against Edgewell Personal Care Brands, LLC, Edgewell Personal Care, LLC, and Sun Pharmaceuticals, LLC. 
  • Why: Chabla and Barton claim Edgewell and Sun market and sell Banana Boat sunscreen sprays that contain benzene, a known human carcinogen.
  •  Where: The class action lawsuit was filed in Connecticut federal court.

Edgewell Personal Care Brands and Sun Pharmaceuticals marketed and sold Banana Boat sunscreen sprays containing benzene, a known human carcinogen, a new class action lawsuit alleges. 

Plaintiffs Luis Chabla and Jessica Barton claim Edgewell and Sun Pharmaceuticals misled and deceived consumers by not listing benzene on the products’ packaging or labeling. 

Chabla and Barton want to represent a nationwide class of consumers and a New York subclass of consumers who purchased the affected Banana Boat sunscreen spray products. 

Chabla and Barton say they both purchased Banana Boat sunscreen sprays without knowing that they contained benzene, and that, had they known, they would not have purchased or paid more for them. 

The Banana Boat sunscreen sprays were ultimately rendered “worthless” due to the presence of benzene, Chabla and Barton say. 

“Accordingly, Plaintiffs were injured in fact and lost money as a result of Defendants’ improper conduct,” the lawsuit states. 

Benzene is Carcinogenic to Humans, Agencies Report 

The benzene contamination was brought to light following a study by Valisure, an independent analytical pharmacy, which discovered benzene in 43 out of 234 sunscreens they tested — including certain Banana Boat sunscreen sprays, according to the class action lawsuit. 

The World Health Organization and the International Agency for research on cancer have both classified benzene as “carcinogenic to humans,” the lawsuit states. 

Chabla and Barton claim consumers expect a product’s packaging and labeling to contain an accurate ingredients list and full disclosure of what it contains. 

“Plaintiffs and Class Members lost the entire benefit of their bargain when what they received was a sunscreen product contaminated with a known carcinogen,” the lawsuit states . 

Chabla and Barton claim Edgwell and Sun are guilty of fraudulent concealment and in violation of New York General Business Law. They are demanding a jury trial and requesting monetary, treble, statutory and punitive damages for themselves and all class members. 

Multiple class action lawsuits have been filed against companies over concerns of benzene contamination, including Bayer, Prestige Consumer Healthcare and Procter & Gamble, among others.

    Add me to any products containing Benzene, I have used multiple sunscreen products and other items that may contain this deadly chemical. I have had serious skin cancer. And now I suffer Leukemia,. stage 4 in treatment. No one knows how I got it.
