CeraVe, Eucerin face class actions over alleged ‘baby’ skincare price premiums

CeraVe, Eucerin class action lawsuits overview:

Who: Two class action lawsuits accuse Beiersdorf Inc. and L’Oréal USA S/D Inc. of selling nearly identical adult and “baby” versions of the same skincare products.
Why: Both companies allegedly charge a premium for products marketed as specially formulated for infants despite sharing the same ingredients as their standard versions.

Two new class action lawsuits allege major skincare companies are charging parents a premium for “baby” versions of eczema and healing products that are materially identical to their standard adult formulas.

Plaintiffs Kendall Nguyen and two others filed a class action lawsuit against Beiersdorf over its Eucerin Baby Eczema Relief Cream. Plaintiff Monica Raymundo filed a separate class action lawsuit against L’Oreal over its CeraVe Baby Healing Ointment and CeraVe Baby Eczema Cream.

Both class action lawsuits argue the companies use the word “baby,” pediatrician references and infant-focused imagery to convince parents the products are specially formulated for infant skin.

In reality, according to both complaints, the baby and adult or standard versions share the same active ingredient at the same concentration, the same inactive ingredients in the same order, and identical directions for use.

The Eucerin class action lawsuit claims the baby and adult products are “materially identical in all relevant respects, including package size, active ingredient, active ingredient concentration, inactive ingredients, overall formulation and directions for use.”

Both lawsuits argue that because the underlying formulas are the same, the only real difference between the baby and adult products is marketing, yet that marketing lets each company charge substantially more for the “baby” label.

Class action lawsuits highlight different pricing evidence

The Eucerin class action lawsuit claims a 5 oz container of the adult product sells for $9.78 at Walmart compared with $13.19 for the same-size baby product, a premium it calls “as much as 35% or more.”

The CeraVe lawsuit uses per-ounce pricing: baby eczema cream sells for $13.99 on cerave.com ($2.80 per ounce) compared with $17.99 ($2.25 per ounce) for the standard version, and the baby healing ointment sells for $14.49 at CVS compared $10.79 for the identically sized standard version.

The CeraVe class action lawsuit cites L’Oreal’s own packaging history: the company described a “new look” but the “same great formula” when it added “baby”-styled branding to the healing ointment. The Eucerin lawsuit cites similar fine print, where Beiersdorf calls the baby product the “same trusted formula” as its adult cream.

Both class action lawsuits seek to represent California consumers who bought the baby products for personal use within the last four years, and both plaintiffs’ groups have demanded a jury trial.

In 2025, a class action lawsuit accused Unilever of falsely labeling and marketing its Vaseline Baby Healing Jelly as hypoallergenic.
