Costco, Johnson & Johnson Sunscreen Class Action Lawsuit Overview:

  • Why: The consumers lodged multiple class action lawsuits alleging certain sunscreens that contained a carcinogenic ingredient benzene and the settlement, if approved, will end the litigation. 
  • Who: Consumers from several states reached a settlement with Costco and Johnson & Johnson.
  • Where: The consolidated class action lawsuits and settlement are being litigated in Florida federal court.

Costco and Johnson & Johnson have reached a preliminary settlement agreement with a group of consumers, announcing a proposed end to multiple class action lawsuits regarding the manufacturing and distribution of Neutrogena and Aveeno sunscreens that contained benzene, a known cancer-causing ingredient. 

The parties told a Florida federal judge that they have reached an “agreement in principle” and are drafting a settlement agreement. The settlement should be submitted for court by November 19, 2021. 

Costco, Johnson & Johnson Sold Sunscreen Containing Benzene, Claimed Class Actions

The multidistrict litigation centralized class action lawsuits from California, Florida, New Jersey, and New York. The class actions accused Johnson & Johnson, the manufacturer, and Costco, the retailer, of failing to inform customers that certain sunscreen products contain benzene, an ingredient that is known to cause many forms of cancer. 

Despite the impending settlement, Johnson & Johnson still disputes the claims and does not admit any liability or wrongdoing, reported Law360.

Five Neutrogena and Aveeno sunscreens in question were recalled by Johnson & Johnson in July. The company also pledged to issue refunds for the products. 

The settlement amount was not available, but Top Class Actions will continue to monitor the Johnson & Johnson, Costco sunscreen class action proceedings for developments.
